Exemplary Damages, Joint Liability and Wrongful Death Claims for Corpus Christi Car Crashes
When a Corpus Christi car crash involves a drunk or reckless driver, or ends in a death, the Texas Civil Practice and Remedies Code answers three questions: when exemplary damages can be awarded and how far they can go, when one defendant pays more than its own share, and who brings the claim for the family.
When Exemplary Damages Are Available
Under Texas Civil Practice and Remedies Code 41.003, exemplary damages may be awarded only if the claimant proves by clear and convincing evidence that the harm results from fraud, malice or gross negligence, and only if the jury is unanimous on liability for and the amount of those damages. Evidence of ordinary negligence does not satisfy that burden.
The Cap and the Intoxication Exception
Section 41.008(b) caps exemplary damages at the greater of two times economic damages plus noneconomic damages found by the jury up to $750,000, or $200,000. Under 41.008(c), the cap does not apply to conduct described as a felony in listed Penal Code sections, including intoxication assault and intoxication manslaughter; for the other listed felonies, the conduct must have been committed knowingly or intentionally.
When One Defendant Pays the Whole Recovery
Under Section 33.013(a), a liable defendant pays only the percentage of damages equal to its own percentage of responsibility. Under 33.013(b), a defendant found more than 50 percent responsible is also jointly and severally liable for the claimant’s recoverable damages, as is a defendant who acted in concert with another person, with specific intent to harm, in listed Penal Code conduct.
Who Brings a Death Claim
Under Section 71.002(b), a person is liable for damages from an injury that causes death if the injury was caused by that person’s or that person’s agent’s or servant’s wrongful act, neglect, carelessness, unskillfulness or default. Under 71.004, the action is for the exclusive benefit of the surviving spouse, children and parents; any of them may bring it for all, and if none has begun the action within three calendar months after the death, the executor or administrator must bring it unless all of them request otherwise.
Corpus Christi Car Accident Questions
Can I recover if I was partly at fault?
Yes, unless your percentage of responsibility is greater than 50 percent under Texas Civil Practice and Remedies Code 33.001. For example, imagine $90,000 in damages and 20 percent of the responsibility on the injured driver: the recovery would be $72,000.
How long do I have to sue?
Two years after the day the cause of action accrues under Section 16.003(a) for personal injury, and two years after the death under 16.003(b) for a wrongful death action, except as provided by the sections listed in 16.003(a). For a crash with a City of Corpus Christi vehicle, Section 101.101 entitles the city to notice within six months after the incident, describing the injury, the time and place and the incident, unless it had actual notice or a ratified charter period applies.
What must the other driver do at the scene?
Under Texas Transportation Code 550.021 and 550.023, stop, determine whether anyone needs aid, give name, address, vehicle registration number and liability insurer, show a driver’s license on request, and provide reasonable assistance, including transport to a physician or hospital when treatment is apparently necessary or the injured person asks.
