Colorado Helmet, Passenger and Fault Rules for Aurora Motorcycle Crashes
Colorado’s motorcycle statute sets helmet rules by age and seating rules for every rider. In an Aurora crash claim, those rules sit alongside the state’s fault comparison and the rider’s own uninsured motorist coverage.
Helmets for Riders Under 18
Except as provided for certain autocycles, C.R.S. 42-4-1502(4.5)(a) bars driving or riding as a passenger on a motorcycle, autocycle or low-power scooter on a roadway unless each person under 18 is wearing a protective helmet made for motorcycle operators, meeting the standard in paragraph (b) (including FMVSS 218), and secured with a chin strap while the vehicle is moving. A violation is a class A traffic infraction under subsection (5).
Seating and Passengers
Under C.R.S. 42-4-1502(1), (2) and (4), the driver rides only on the permanent seat, astride and facing forward; a passenger may ride only if the motorcycle is designed to carry more than one person, on a seat designed for two or one firmly attached at the rear or side; and no one may ride in a position that interferes with the operation or control of the motorcycle or the operator’s view.
The Fault Comparison
Under C.R.S. 13-21-111(1), the rider’s negligence does not bar recovery if it was not as great as the negligence of the party against whom recovery is sought, and damages are reduced in proportion. For example, imagine $100,000 in damages and 30 percent of the fault on the rider: the recovery would be $70,000.
Uninsured Motorist Coverage
C.R.S. 10-4-609(1)(a) requires motor vehicle liability policies issued in Colorado to include uninsured motorist coverage at the limits of 42-7-103(2), unless the named insured rejects it in writing.
Aurora Motorcycle Accident Questions
Does Colorado require adult riders to wear helmets?
No, not under 42-4-1502(4.5): its helmet requirement applies to each person under 18. An autocycle with three wheels, a maximum design speed of 25 miles per hour or less, a windshield and seat belts is excepted.
How long do I have to sue?
Three years after the cause of action accrues under C.R.S. 13-80-101(1)(n), for tort actions for bodily injury or property damage arising out of the use or operation of a motor vehicle. A claim against a public entity, such as one over a city vehicle or a road defect, needs written notice within 182 days after discovery of the injury under C.R.S. 24-10-109(1).
If two drivers share fault, can I collect everything from one of them?
No. Except as provided in subsection (4), C.R.S. 13-21-111.5(1) limits each defendant to its own percentage of fault.
