Driver Qualifications, Weekly Hours and Carrier Records in Dallas Truck Crash Claims
A Dallas truck crash claim can look at whether the driver was qualified to drive, how many hours the driver had worked over the past week, and which records the carrier had to keep. Texas law then divides responsibility among every person who contributed to the crash.
Who May Drive
Except as provided in subpart G, 49 CFR 391.11(b) qualifies a person to drive a commercial motor vehicle only if the person is at least 21, can read and speak English sufficiently, can safely operate the vehicle by experience or training, is physically qualified, holds one currently valid commercial license, is not disqualified under 391.15, and has completed a road test or presented an accepted equivalent.
Weekly Hours
Under 49 CFR 395.3(b), a property-carrying driver may not drive after 60 hours on duty in 7 consecutive days if the carrier does not operate every day, or after 70 hours in 8 consecutive days if it does; 395.3(c) allows a restart after 34 or more consecutive hours off duty.
Records the Carrier Keeps
Under 49 CFR 395.8(a), the carrier must require electronic logging of duty status, with manual records in listed cases, and under 395.8(k)(1) it keeps duty-status records and supporting documents for at least 6 months from receipt. Under 390.15(b), the carrier keeps an accident register for 3 years after each accident, with copies of required accident reports.
Every Contributor’s Percentage
Under Texas Civil Practice and Remedies Code 33.003(a), the trier of fact assigns a whole-number percentage of responsibility to each claimant, defendant, settling person and responsible third party designated under 33.004, and under 33.013(b) a defendant more than 50 percent responsible is jointly and severally liable for the claimant’s recoverable damages.
Dallas Truck Accident Questions
Can I recover if I was partly at fault?
Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $200,000 in damages and 25 percent of the responsibility on the injured driver: the recovery would be $150,000.
How long do I have to sue the carrier?
Two years after the day the cause of action accrues under Section 16.003(a) for personal injury, and two years after the death under 16.003(b) for wrongful death. If the truck was a City of Dallas vehicle, Section 101.101 entitles the city to notice within six months after the incident unless it had actual notice of the injury, a charter notice period ratified under 101.101(b) can apply instead, and 101.023(c) limits the city to $250,000 per person and $500,000 per occurrence for bodily injury or death.
Who must be notified after a truck crash inside Dallas?
The local police department, under Texas Transportation Code 550.026(a), when the collision occurs in a municipality and causes injury, death or damage leaving a vehicle unable to be normally and safely driven.
