City Vehicle Claims, Settlement Credits and Fault Shares for Dallas Car Crashes
A Dallas car crash with a city vehicle runs on Chapter 101 of the Texas Civil Practice and Remedies Code, which sets its own liability rule, caps and notice requirement. In every Dallas case, the jury assigns a percentage of responsibility to each person involved, and any settlement already paid reduces what the claimant can still recover.
When a Government Unit Is Liable
Under Texas Civil Practice and Remedies Code 101.021, a governmental unit is liable for injury and death caused by an employee acting within the scope of employment if the harm arises from the operation or use of a motor-driven vehicle or equipment and the employee would be personally liable under Texas law, and for injury caused by a condition or use of tangible personal or real property. Under 101.055(2), the chapter does not apply to an employee’s emergency response that complied with the laws for emergency action or, absent such a law, was not taken with conscious indifference or reckless disregard for others’ safety.
Caps for a Municipality
Under Section 101.023(c), the liability of a municipality such as the City of Dallas is limited to $250,000 for each person and $500,000 for each single occurrence for bodily injury or death, and $100,000 for each single occurrence for property damage. Other units of local government are limited to $100,000 and $300,000 under 101.023(b).
Notice of the Claim
Under Section 101.101(a), a governmental unit is entitled to notice of the claim within six months after the incident, reasonably describing the injury, the time and place, and the incident. Under 101.101(b), notice periods set by a city’s charter and ordinances are ratified, and under (c) the notice requirement does not apply if the unit has actual notice of the death, injury or property damage.
Responsibility Shares and Settlements
Under Section 33.003(a), the trier of fact assigns a percentage of responsibility, in whole numbers, to each claimant, defendant, settling person and designated responsible third party. Under 33.012(a) and (b), the claimant’s damages are reduced by the claimant’s own percentage and then by the sum of the dollar amounts of all settlements.
Dallas Car Accident Questions
Can I recover if I was partly at fault?
Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $200,000 in damages and 25 percent of the responsibility on the injured driver: the recovery would be $150,000, before any reduction for settlements.
Does the two-year deadline run against an injured child?
No, not while the child is under 18. Section 16.003 sets two years for personal injury, and under 16.001 the time of a legal disability, including being younger than 18, is not counted if it exists when the cause of action accrues.
Who brings the claim if a driver is killed?
The surviving spouse, children and parents, or any of them for the benefit of all, under Section 71.004. If none has begun the action within three calendar months after the death, the executor or administrator must bring it unless all of them request otherwise.
