Helmet Rules, Underinsured Motorist Coverage and Estate Claims for North Las Vegas Motorcycle Crashes
A North Las Vegas motorcycle crash claim can raise Nevada’s helmet and eye protection statute, what the rider’s own uninsured and underinsured motorist coverage pays, and how a settlement with one defendant affects the rest. When a rider dies, Nevada splits the recovery between the heirs and the estate.
Helmets and Eye Protection
Under NRS 486.231(2), when a motorcycle or moped is driven on a highway, the driver and passenger must wear securely fastened protective headgear and protective glasses, goggles or face shields meeting the Department’s standards; under (3), a transparent windscreen meeting those standards replaces the eye protection, and (4) and (5) exempt authorized parades and enclosed-cab three-wheel vehicles other than trimobiles.
Uninsured and Underinsured Motorist Coverage
Under NRS 687B.145(2), insurers must offer, on an approved form, uninsured and underinsured vehicle coverage equal to the bodily injury limits sold for a passenger car or motorcycle. The coverage lets the insured recover damages that exceed the other driver’s bodily injury limits, up to the insured’s own limits, and the insurer need not reoffer it in a replacement policy, though the insured may request it in writing.
Settlements and Several Liability
Under NRS 41.141(3), when a defendant settles before judgment, that defendant’s negligence and the settlement amount are not put before the jury, and the judge deducts the settlement from the net recovery. Under (4), each remaining defendant is severally liable only for its percentage of negligence, except in the actions listed in (5), such as those based on an intentional tort or a defective product.
The Estate’s Claim
Under NRS 41.085(5), the personal representative may recover for the estate the decedent’s medical expenses before death, funeral expenses, and any penalties, including punitive damages, the decedent would have recovered, but not damages for the decedent’s pain, suffering or disfigurement, which belong to the heirs under (4). The estate’s proceeds are liable for the decedent’s debts unless exempted by law.
North Las Vegas Motorcycle Accident Questions
How long do I have to sue?
Two years under NRS 11.190(4)(e) for an action to recover damages for injuries to a person or for a death caused by the wrongful act or neglect of another, except as otherwise provided in NRS 11.215 or 11.217. For a city or State vehicle, the claim goes to the governing body or the Attorney General within 2 years under NRS 41.036, and the award may not exceed $200,000 per claimant under 41.035(1).
Can I recover if I was partly at fault?
Yes, if your negligence was not greater than the negligence of the defendants, under NRS 41.141(1). For example, imagine $95,000 in damages and 35 percent of the negligence on the rider: the recovery would be $61,750.
Is there a cap on punitive damages?
Yes, with exceptions. Under NRS 42.005(1), punitive damages require clear and convincing evidence of oppression, fraud or malice and may not exceed three times compensatory damages of $100,000 or more, or $300,000 when compensatory damages are less than $100,000; (2) lists actions the limits do not reach.
