Driver Qualifications, Personal Injury Protection and Wrongful Death Caps in Baltimore Truck Crash Claims
A Baltimore truck crash claim can draw on the carrier’s driver qualification file and its accident register and annual inspection records. Maryland law adds personal injury protection that can pay medical bills before fault is decided, sets who benefits from a wrongful death action and caps noneconomic damages.
Who May Drive
Except as provided in subpart G, 49 CFR 391.11(b) requires a commercial driver to be at least 21, able to read and speak English sufficiently, able by experience or training to operate the vehicle safely, physically qualified, holding a currently valid commercial license issued by only one jurisdiction, not disqualified, and to have passed a road test or hold a license or certificate the carrier accepted as equivalent.
The Injured Driver’s Own Personal Injury Protection
Under Md. Code, Insurance § 19-505, personal injury protection provides at least $2,500 for medical and related expenses incurred within three years and 85 percent of lost income and essential services, covering the named insured and household members, permissive users, guests and pedestrians, unless the coverage was waived under § 19-506. Ask the insurer whether a waiver is on file before counting on it after a truck crash.
Accident Register and Annual Inspection
Under 49 CFR 390.15(b), the carrier keeps an accident register for 3 years after each accident, listing date, location, driver, injuries, fatalities and any hazardous materials release, together with copies of required accident reports. Under 49 CFR 396.17, each commercial motor vehicle, including each unit of a combination, must have passed a periodic inspection within the preceding 12 months.
A Wrongful Death Action
Under Md. Code, Courts and Judicial Proceedings § 3-904(a), (b) and (g)(1), a wrongful death action is for the benefit of the spouse, parent and child of the deceased, or if none, a relative by blood or marriage who was substantially dependent on the deceased, and it must be filed within three years after the death. Under § 11-108(b)(3)(ii), noneconomic damages in a wrongful death action with two or more claimants may not exceed 150 percent of the general cap.
Contributory Negligence
In Coleman v. Soccer Ass’n of Columbia (2013), the Court of Appeals of Maryland declined to abrogate contributory negligence, and the jury’s contributory negligence finding barred the plaintiff from any recovery. A trucking defendant can raise the same defense against a driver who shared fault for the crash.
Baltimore Truck Accident Questions
How long do I have to sue the trucking company?
Three years from accrual under Courts and Judicial Proceedings § 5-101, unless another provision sets a different period, and three years after the death for a wrongful death action under § 3-904(g)(1).
What is the noneconomic damages cap in a fatal truck crash?
For a cause of action arising from October 1, 2026 through September 30, 2027, the general cap under Courts and Judicial Proceedings § 11-108 is $980,000, and in a wrongful death action with two or more claimants it is 150 percent of that amount, or $1,470,000.
What if a city truck caused the crash?
Under Courts and Judicial Proceedings § 5-304, written notice must be given within one year after the injury, to the City Solicitor for Baltimore City, and under § 5-303(a)(1) a local government’s liability may not exceed $400,000 per individual claim and $800,000 per occurrence.
