Truck Maintenance, Hazardous Loads and Wrongful Death Actions in Omaha Truck Crash Cases
An Omaha truck crash claim can begin with the truck’s maintenance history, the coverage tier for its load and the federal alcohol rule for its driver. Nebraska law then sets the contributory negligence bar and the deadline and settlement rules for a wrongful death action.
Maintenance and Inspection
Under 49 CFR 396.3, every motor carrier must systematically inspect, repair and maintain each vehicle subject to its control, keep maintenance records for 1 year where the vehicle is housed or maintained, and keep them for 6 months after the vehicle leaves its control. Under 396.17, each commercial motor vehicle, including each unit of a combination, must have passed a periodic inspection within the preceding 12 months.
Hazardous Loads and Alcohol
Under 49 CFR 387.9, listed oil and hazardous materials not covered by the higher rows require $1,000,000 in public liability coverage, and bulk hazardous substances and listed explosive, poison and radioactive categories require $5,000,000. Under 382.201, a driver subject to the federal testing rules may not report for or remain on safety-sensitive duty with an alcohol concentration of 0.04 or greater.
The Contributory Negligence Bar
Under Neb. Rev. Stat. 25-21,185.09, contributory negligence diminishes the damages in proportion but does not bar recovery unless it is equal to or greater than the total negligence of all persons against whom recovery is sought.
A Wrongful Death Action
Under Neb. Rev. Stat. 30-810, a wrongful death action must be commenced within two years after the death by the personal representative for the exclusive benefit of the widow or widower and next of kin, the recovery is distributed by pecuniary loss, and any settlement needs the appointing court’s approval.
Omaha Truck Accident Questions
How long do I have to sue after an Omaha truck crash?
Four years under Neb. Rev. Stat. 25-207(3) for an injury claim. A claim against a political subdivision must be made in writing within one year under 13-919(1).
Can I recover if I was partly at fault?
Yes, if your negligence is less than the total negligence of those you are suing. For example, imagine $220,000 in damages and 35 percent of the negligence on the injured driver: under 25-21,185.09 the recovery would be $143,000.
What is the penalty for a truck driver who leaves an injury crash?
Under Neb. Rev. Stat. 60-698(1), a driver convicted of violating the 60-697 duty to stop commits a Class IIIA felony if the crash caused injury other than serious bodily injury, and a Class III felony if it caused death or serious bodily injury, with a court order barring driving for 1 to 15 years.
