Maintenance, Driver Testing and Hit-and-Run Rules in Santa Ana Truck Crash Claims
In a Santa Ana truck crash, federal rules reach the truck’s maintenance history and the driver’s alcohol and drug testing. California’s Vehicle Code governs what every driver must do at the scene.
Systematic Maintenance
Under 49 CFR 396.3, every motor carrier must systematically inspect, repair and maintain each vehicle subject to its control, keep maintenance records for 1 year where the vehicle is housed or maintained, and keep them for 6 months after the vehicle leaves its control.
Alcohol and Post-Crash Tests
Under 49 CFR 382.201, a driver subject to the federal testing rules may not report for or remain on safety-sensitive duty with an alcohol concentration of 0.04 or greater. Under 49 CFR 382.303, a fatal crash requires alcohol and drug testing of the surviving driver, and a crash with injury treated away from the scene or a disabling tow-away requires it when the commercial driver is cited for a moving violation arising from the crash within 8 hours (alcohol) or 32 hours (drugs); alcohol testing attempts stop at 8 hours and drug testing attempts at 32 hours.
Hazardous Loads
Under 49 CFR 387.9, listed oil and hazardous materials not covered by the higher rows require $1,000,000 in coverage, and bulk hazardous substances and listed explosive, poison and radioactive categories require $5,000,000; nonhazardous for-hire interstate property carriers in vehicles rated 10,001 pounds or more require $750,000.
Leaving the Scene
Vehicle Code § 20001 requires any driver in a crash that injures or kills a person to stop and fulfill § 20003 and § 20004. Under § 20001(b)(2), leaving after a crash that results in death or permanent, serious injury is punishable by two, three or four years in state prison, 90 days to one year in county jail, a fine of $1,000 to $10,000, or both.
Santa Ana Truck Accident Questions
Can I recover if I was partly at fault?
Yes. Li v. Yellow Cab Co. (1975) adopted pure comparative negligence. For example, imagine $400,000 in damages and 25 percent of the fault on the injured driver: the recovery would be $300,000.
What must a claim against the City of Santa Ana or another public entity include?
Government Code § 910 requires the claimant’s name and address, the date, place and circumstances of the occurrence, a general description of the injury, the employee’s name if known, and either the amount claimed if under $10,000 or, above that, whether the claim would be a limited civil case. Under § 911.2, an injury claim is due within six months after accrual.
How long do I have to sue the carrier?
Two years under Code of Civil Procedure § 335.1 for injury or death caused by another’s wrongful act or neglect.
