Glendale Truck Crashes: Federal Insurance and Hours Rules With Arizona Fault Law
For a Glendale truck crash, the federal motor carrier rules answer two practical questions, how much insurance the carrier had to carry and how long the driver was allowed to drive, while Arizona law sets the fault rule and deadlines.
Minimum Carrier Coverage
Under 49 CFR § 387.9, a for-hire carrier hauling nonhazardous property in interstate or foreign commerce with vehicles rated at 10,001 pounds or more must carry at least $750,000 in public liability coverage; listed oil and hazardous cargo carry $1,000,000 or $5,000,000 minimums. Section 387.7(a) bars a carrier from operating a motor vehicle until that coverage is in effect.
Daily and Weekly Driving Limits
Subject to the exceptions in 49 CFR § 395.1, § 395.3 allows a property-carrying driver 11 hours of driving within 14 consecutive hours after 10 hours off duty, requires a 30-minute break after 8 hours of driving unless a short-haul exception applies, and bars driving after 60 hours on duty in 7 days or 70 hours in 8 days depending on the carrier’s schedule. Under § 395.8(k), the carrier keeps duty status records at least six months, and the driver must carry the records for the previous seven consecutive days while on duty.
Arizona’s Fault Rule
Under A.R.S. § 12-2505(A), the injured person’s fault reduces the full damages proportionately and does not bar the action. For example, imagine $150,000 in damages and 10 percent of the fault on the injured driver: the damages would be $135,000. A.R.S. § 12-2506 then limits each defendant to its own percentage of fault, subject to the exceptions in subsection (D).
Glendale Truck Accident Questions
What alcohol limit applies to the truck driver?
49 CFR § 382.201 bars a covered driver from reporting for or remaining on duty requiring safety-sensitive functions with an alcohol concentration of 0.04 or greater.
How long do I have to file?
Two years after the cause of action accrues under A.R.S. § 12-542, except as provided in § 12-551. For a public entity or public employee, the claim is due within 180 days under § 12-821.01 and the lawsuit within one year under § 12-821.
The injured person is a minor. Does the public entity deadline still run?
No, not while the disability lasts. Under A.R.S. § 12-821.01(D), a minor or an insane or incompetent person may file the claim within 180 days after the disability ceases.
