Medical Coverage, Responsible Third Parties and State Claims for Laredo Car Crashes

A Laredo car crash can raise whether the injured driver’s own policy pays medical bills first, a third party the defendant blames, or a state-maintained road. The Texas Insurance Code and the Texas Civil Practice and Remedies Code each answer part of the claim.

Personal Injury Protection

Under Texas Insurance Code 1952.152, an automobile liability policy includes personal injury protection unless any named insured rejects it in writing. Under 1952.151, the coverage pays reasonable expenses arising from the accident and incurred within three years from the date of the accident, and under 1952.156 benefits are paid no later than the 30th day after the insurer receives satisfactory proof of a claim.

Responsible Third Parties

Under Texas Civil Practice and Remedies Code 33.003(a), the trier of fact assigns a whole-number percentage of responsibility to each claimant, defendant, settling person and responsible third party designated under 33.004. Under 33.003(b), no question about a person’s conduct may go to the jury without sufficient evidence to support it.

Claims Involving the State

Under Section 101.021, a governmental unit is liable for injury from an employee’s operation or use of a motor-driven vehicle when the employee would be personally liable, and for injury caused by a condition or use of tangible personal or real property. Under 101.023(a), the state’s liability is limited to $250,000 per person and $500,000 per occurrence for bodily injury or death and $100,000 per occurrence for property damage. Under 101.055(2), the chapter does not apply to an employee’s response to an emergency call or emergency situation that complied with the laws for emergency action or, absent such a law, was not taken with conscious indifference or reckless disregard for others’ safety.

Notice of a Government Claim

Under Section 101.101(a), the governmental unit is entitled to notice within six months after the incident, reasonably describing the injury, the time and place, and the incident; under (c), the requirement does not apply if the unit has actual notice of the death, injury or property damage.

Laredo Car Accident Questions

Can I recover if I was partly at fault?

Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $100,000 in damages and 30 percent of the responsibility on the injured driver: the recovery would be $70,000.

How long do I have to sue?

Two years after the day the cause of action accrues under Section 16.003(a) for personal injury, and two years after the death under 16.003(b) for wrongful death.

Does my policy cover a driver with no insurance?

Yes, if it is an automobile liability policy and the coverage was not rejected in writing. Under Texas Insurance Code 1952.101, an automobile liability policy covering liability for the use of any motor vehicle must include uninsured or underinsured motorist coverage unless any insured named in the policy rejects it in writing.
