Uninsured Motorist Coverage, Liability Minimums and Death Claims for El Paso Car Crashes

When the driver who caused an El Paso car crash had no insurance or too little, the Texas Insurance Code decides whether the injured person’s own policy pays. The Transportation Code sets the liability minimums, and the Civil Practice and Remedies Code governs claims when a crash is fatal.

What Uninsured Motorist Coverage Protects

Under Texas Insurance Code 1952.101(a), uninsured or underinsured motorist coverage protects insureds who are legally entitled to recover from owners or operators of uninsured or underinsured motor vehicles for bodily injury, sickness, disease or death, or property damage, in at least the limits prescribed by Chapter 601 of the Transportation Code. Under (b) and (c), an automobile liability policy must include it unless any insured named in the policy rejects it in writing.

Liability Minimums

Texas Transportation Code 601.072(a-1) sets minimum liability coverage of $30,000 for bodily injury to or death of one person, $60,000 for two or more persons in one collision and $25,000 for property damage. Under 601.072(b), the coverage may exclude the first $250 of liability for one person, the first $500 for two or more persons and the first $250 for property damage.

A Fatal Crash

Under Texas Civil Practice and Remedies Code 71.002(b), a person is liable for damages from an injury that causes death if it was caused by that person’s or that person’s agent’s or servant’s wrongful act, neglect, carelessness, unskillfulness or default. Under 71.004, the surviving spouse, children and parents, or any of them for all, bring the action; if none has begun it within three calendar months after the death, the executor or administrator must bring it unless all of them request otherwise.

Injured Children

Under Section 16.001, a person younger than 18 is under a legal disability; if the disability exists when the cause of action accrues, its time is not included in the limitations period, and one disability may not be tacked to another to extend the period.

El Paso Car Accident Questions

Can I recover if I was partly at fault?

Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $100,000 in damages and 25 percent of the responsibility on the injured driver: the recovery would be $75,000.

How long do I have to sue?

Two years after the day the cause of action accrues under Section 16.003(a) for personal injury, and two years after the death under 16.003(b) for wrongful death. A claim against the City of El Paso or another governmental unit has an earlier step: under Section 101.101, the unit is entitled to notice within six months after the incident describing the injury, the time and place and the incident, unless it had actual notice of the injury, and a city charter notice period ratified under 101.101(b) can apply instead. Check the charter’s notice period before relying on six months.

What must the other driver do at the scene?

Under Texas Transportation Code 550.021 and 550.023, stop, determine whether anyone needs aid, remain at the scene, give name, address, vehicle registration number and liability insurer, show a driver’s license on request and provide reasonable assistance to anyone injured.
