Public Entity Claims, Wrongful Death Deadlines and Punitive Damages for Jersey City Car Crashes

A Jersey City car crash with a city or county vehicle runs into New Jersey’s 90-day notice for claims against public entities and its limits on what those entities pay. New Jersey also sets a separate wrongful death deadline and a high bar and cap for punitive damages.

The 90-Day Notice to a Public Entity

Under N.J.S.A. 59:8-8, a claim for injury against a public entity must be presented within 90 days after the cause of action accrues, suit may be filed six months after the claim is received, and the claim is forever barred if it was not filed within 90 days, except as allowed under 59:8-9, or if two years have passed since accrual.

What a Public Entity Does Not Pay

Under N.J.S.A. 59:9-2, no prejudgment interest or punitive damages are awarded against a public entity, and pain and suffering damages are barred unless the case involves permanent loss of a bodily function, permanent disfigurement or dismemberment with medical treatment expenses over $3,600. Collateral insurance benefits other than from a joint tortfeasor are deducted.

The Wrongful Death Deadline

Under N.J.S.A. 2A:31-3, a wrongful death action must be commenced within two years after the death, but if the death resulted from murder, aggravated manslaughter or manslaughter for which the defendant was convicted, the action may be brought at any time.

When Punitive Damages Are Available

Under N.J.S.A. 2A:15-5.12, punitive damages require clear and convincing evidence that the harm resulted from actual malice or a wanton and willful disregard of persons who foreseeably might be harmed, and they may not be awarded for any degree of negligence, including gross negligence.

Jersey City Car Accident Questions

How long do I have to sue after a Jersey City car crash?

Two years under N.J.S.A. 2A:14-2 for an injury claim, except as otherwise provided by law, and two years after the death for a wrongful death action under 2A:31-3.

What if more than one driver caused the crash?

Your negligence is compared with the combined negligence of the persons you are suing under N.J.S.A. 2A:15-5.1. For example, imagine $150,000 in damages, 40 percent of the negligence on the injured driver, 45 percent on one driver and 15 percent on another: the recovery would be $90,000, and because neither driver reaches 60 percent, under 2A:15-5.3(c) each pays only its own share: $67,500 and $22,500.

Can I recover pain and suffering under the lawsuit threshold?

Yes, but only for listed injuries. Under N.J.S.A. 39:6A-8(a), a person subject to the limitation on lawsuit option recovers noneconomic loss only for death, dismemberment, significant disfigurement or scarring, displaced fractures, loss of a fetus, or a permanent injury within a reasonable degree of medical probability.
