Death Claims, Joint Liability and PIP Payment Timing for Brownsville Car Crashes

A Brownsville car crash can end in a death claim brought by the family, a lawsuit against several defendants with different shares of fault, or a claim on the injured person’s own personal injury protection. Texas statutes set the rules for each.

A Fatal Crash

Under Texas Civil Practice and Remedies Code 71.002(b), a person is liable for damages from an injury that causes death if it was caused by that person’s or that person’s agent’s or servant’s wrongful act, neglect, carelessness, unskillfulness or default. Under 71.004, the action is for the exclusive benefit of the surviving spouse, children and parents, and under 16.003(b) it must be brought within two years after the death.

When One Defendant Pays More Than Its Share

Under Section 33.013(a), a liable defendant pays only the percentage of damages equal to its percentage of responsibility. Under 33.013(b), a defendant whose percentage is greater than 50 percent is also jointly and severally liable for all of the claimant’s recoverable damages.

When PIP Must Be Paid

Under Texas Insurance Code 1952.156, personal injury protection benefits are paid as claims arise and no later than the 30th day after the insurer receives satisfactory proof of a claim. The policy may require the original proof of loss within a period of not less than six months after the accident, and total benefits may not exceed the policy’s limits.

Damage-Only Collisions

Under Texas Transportation Code 550.022, a driver in a collision that damages only a vehicle that is driven or attended must stop, return if not stopped at the scene, and remain until the 550.023 duties are met: giving name, address, registration number and liability insurer, and showing a driver’s license on request.

Brownsville Car Accident Questions

Can I recover if I was partly at fault?

Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $200,000 in damages and 30 percent of the responsibility on the injured driver: the recovery would be $140,000.

How long do I have to sue for my injuries?

Two years after the day the cause of action accrues under Section 16.003(a), except as provided by the sections that subsection lists. If a City of Brownsville vehicle or a state vehicle was involved, notice comes first: Section 101.101 entitles the governmental unit to notice within six months after the incident unless it had actual notice of the injury, a city may use a charter notice period ratified under 101.101(b), and 101.023 limits the state and a municipality to $250,000 per person and $500,000 per occurrence for bodily injury or death.

Who must be notified after an injury crash in Brownsville?

The local police department. Under Texas Transportation Code 550.026(a), a collision in a municipality that causes injury, death or damage leaving a vehicle unable to be normally and safely driven must be reported immediately by the quickest means of communication.
