The Comparative Fault Bar, Insurance Minimums and Leaving the Scene in Indianapolis Car Crash Claims
An Indianapolis car crash claim in Indiana is reduced by the injured person’s share of fault and barred only when that share is greater than the fault of everyone whose fault contributed. Indiana also sets financial responsibility minimums, requires insurers to make uninsured and underinsured coverage available, and grades leaving the scene by the harm caused.
The Comparative Fault Rule
Under IC 34-51-2-5, contributory fault diminishes compensatory damages in proportion and does not bar recovery except as provided in section 6. Under IC 34-51-2-6, the claimant is barred if the claimant’s contributory fault is greater than the fault of all persons whose fault proximately contributed to the damages.
Financial Responsibility Minimums
Under IC 9-25-4-5, the minimum amounts of financial responsibility are $25,000 for bodily injury to or death of one individual, $50,000 for two or more individuals in one accident, and, beginning July 1, 2018, $25,000 for property damage in one accident.
Uninsured and Underinsured Coverage
Under IC 27-7-5-2(a) and (b), an insurer must make uninsured and underinsured motorist coverage available in each auto liability policy on a vehicle registered or principally garaged in Indiana, and a named insured may reject both coverages, or either one alone, in writing.
Leaving the Scene
Under IC 9-26-1-1.1, an operator involved in a crash must stop, remain, give name, address and registration number and show a driver’s license, and if someone is injured provide reasonable assistance as directed and notify police or 911. Knowingly failing to comply is a Class B misdemeanor, a Class A misdemeanor with bodily injury, a Level 6 felony with moderate or serious bodily injury, and a Level 4 felony with death or catastrophic injury.
Indianapolis Car Accident Questions
How long do I have to sue after an Indianapolis car crash?
Two years after the cause of action accrues, under IC 34-11-2-4(a). A claim against a political subdivision also needs notice within 180 days after the loss under IC 34-13-3-8, and against the state within 270 days under 34-13-3-6.
Can I recover if I was partly at fault?
Yes, unless your fault is greater than the fault of everyone else who contributed. For example, imagine $80,000 in damages and 30 percent of the fault on the injured driver: under IC 34-51-2-5 the recovery would be $56,000.
Is there a cap on punitive damages in Indiana?
Yes. Under IC 34-51-3-4, a punitive damage award may not be more than the greater of three times the compensatory damages awarded or $50,000.
