Comparative Responsibility, Separate Judgments and Government Claims for Boise Car Crashes

A Boise car crash claim in Idaho survives the injured person’s fault only if it is less than the fault of the person being sued, and each defendant is compared individually. Idaho also requires a claim against a city or county within 180 days and limits a governmental entity’s liability to $500,000 per occurrence.

Comparative Responsibility

Under Idaho Code 6-801, contributory negligence or comparative responsibility does not bar recovery if it was not as great as the negligence or comparative responsibility of the person against whom recovery is sought, and damages are diminished in proportion to the fault of the person recovering.

Separate Judgments for Each Defendant

Under Idaho Code 6-803(3), joint and several liability is limited to the causes listed in subsection (5), the fault of each defendant is compared individually to the fault of the person recovering, and judgment is entered against each defendant whose fault exceeds the plaintiff’s for its proportionate share of the total damages. Under (5), a party remains jointly and severally liable for another acting in concert with it or as its agent or servant.

A Claim Against a City or County

Under Idaho Code 6-906, claims against a political subdivision or its employee acting within the scope of employment must be presented to and filed with the clerk or secretary of the political subdivision within 180 days from the date the claim arose or reasonably should have been discovered, whichever is later.

The Government Liability Limit

Under Idaho Code 6-926(1), the combined liability of a governmental entity and its employees for one occurrence may not exceed $500,000 regardless of the number of persons injured, unless the entity has purchased valid liability insurance above that limit, in which case the remaining insurance proceeds control.

Boise Car Accident Questions

How long do I have to sue after a Boise car crash?

Two years under Idaho Code 5-219(4), which covers an action for an injury to the person or for a death caused by the wrongful act or neglect of another.

Can I recover if I was partly at fault?

Yes, if your fault is less than the fault of the driver you are suing. For example, imagine $75,000 in damages and 40 percent of the fault on the injured driver, with 60 percent on the other driver: under Idaho Code 6-801 the recovery would be $45,000.

Must every Idaho vehicle owner carry liability insurance?

Yes. Under Idaho Code 49-1229(1), the owner of a motor vehicle registered and operated in Idaho must continuously provide liability insurance in at least the amount set by section 49-117, unless self-insured or bonded under the section.
