Freeway Collision Duties, Crash Notice and PIP Coverage for Irving Car Crashes
An Irving car crash on a freeway brings in a Texas rule on moving drivable vehicles out of traffic, and every injury crash carries a notice duty. The injured person’s own personal injury protection and the rule on each defendant’s share then shape the claim.
Moving Drivable Vehicles Off the Freeway
Under Texas Transportation Code 550.022(b), if a collision occurs on a main lane, ramp, shoulder, median or adjacent area of a freeway in a metropolitan area and each vehicle can be normally and safely driven, each driver must move as soon as possible to a designated collision investigation site, a location on the frontage road, the nearest suitable cross street or another suitable location to exchange the information 550.023 requires.
Notice of an Injury Crash
Under Section 550.026(a), a collision causing injury, death or damage that leaves a vehicle unable to be normally and safely driven must be reported immediately: to the local police department inside a municipality such as Irving, to the police department or sheriff’s office within 100 feet outside city limits, and otherwise to the sheriff’s office or the nearest office of the department.
What Personal Injury Protection Pays
Under Texas Insurance Code 1952.151, personal injury protection pays the named insured, household members and authorized operators or passengers for reasonable expenses arising from the accident and incurred within three years, including necessary medical and funeral services, lost income for an income producer and essential household services for a person who was not earning income. Under 1952.152, the coverage is included unless any named insured rejects it in writing.
Each Defendant’s Share
Under Texas Civil Practice and Remedies Code 33.013, a liable defendant pays only its own percentage of the damages, unless its percentage of responsibility is greater than 50 percent, in which case it is also jointly and severally liable for the claimant’s recoverable damages.
Irving Car Accident Questions
Can I recover if I was partly at fault?
Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $100,000 in damages and 20 percent of the responsibility on the injured driver: the recovery would be $80,000.
How long do I have to sue?
Two years after the day the cause of action accrues under Section 16.003(a) for personal injury, and two years after the death under 16.003(b) for wrongful death.
What if the claim is against the state?
Under Section 101.101, the state is entitled to notice of the claim within six months after the incident unless it has actual notice of the injury, and under 101.023(a) its liability is limited to $250,000 per person and $500,000 per occurrence for bodily injury or death.
