Public Entity Claims, Underage Alcohol and Punitive Damages for Las Vegas Car Crashes

A Las Vegas car crash with a city, county or State vehicle follows Nevada’s own filing rule and damages limit. Nevada law also decides when an adult who supplied alcohol to an underage driver can be sued, when punitive damages are allowed, and what the heirs can recover when a crash is fatal.

A City, County or State Vehicle

Under NRS 41.036, a tort claim against the State or its agencies is filed with the Attorney General, and a claim against a political subdivision with its governing body, within 2 years after the cause of action accrues; the filing is not a condition precedent to suing. Under NRS 41.035(1), an award against the State, a political subdivision or a public employee acting within the scope of employment may not exceed $200,000 per claimant, excluding interest from the date of judgment, and may not include punitive damages.

Alcohol Supplied to an Underage Driver

Under NRS 41.1305, a person who serves an adult 21 or older is not liable for that adult’s later conduct, but a person who knowingly serves an underage person, or knowingly allows underage drinking on premises or in a conveyance under the person’s control, is liable for damages the underage person causes. Under (3), that liability does not apply to licensed sellers and their employees acting in the course of business.

Punitive Damages

Under NRS 42.005(1), punitive damages require clear and convincing evidence of oppression, fraud or malice and may not exceed three times compensatory damages of $100,000 or more, or $300,000 when compensatory damages are less than $100,000. Under (2), the limits do not apply to listed actions, including those against a manufacturer, distributor or seller of a defective product or an insurer acting in bad faith.

When a Crash Is Fatal

Under NRS 41.085(2), the heirs and the personal representative may each bring an action against the person who caused the death. Under (4), each heir may recover for grief or sorrow, loss of probable support, companionship, society, comfort and consortium, and for the decedent’s pain, suffering or disfigurement.

Las Vegas Car Accident Questions

How long do I have to sue the other driver?

Two years under NRS 11.190(4)(e) for an action to recover damages for injuries to a person or for a death caused by the wrongful act or neglect of another, except as otherwise provided in NRS 11.215 or 11.217.

Can I recover if I was partly at fault?

Yes, if your negligence was not greater than the negligence of the defendants, under NRS 41.141(1). For example, imagine $130,000 in damages and 15 percent of the negligence on the injured driver: the recovery would be $110,500.

Can a missing seat belt be used against me?

No. Under NRS 484D.495(4)(b), a seat belt violation may not be considered as negligence or as causation in any civil action.
