Seat Belt and Child Seat Rules, PIP and Defendant Shares for Amarillo Car Crashes
An Amarillo car crash claim can raise Texas restraint rules for adults and children, the question of whether the injured person’s own policy carries personal injury protection, and how much each liable defendant must pay.
Seat Belts
Under Texas Transportation Code 545.413(a), a person at least 15 years old riding in a passenger vehicle in a seat equipped with a safety belt commits an offense if not secured, punishable by a fine of $25 to $50. Under 545.413(b), a driver who allows a child younger than 17 who is not required to be in a child safety seat to ride unbelted commits an offense punishable by a fine of $100 to $200.
Child Safety Seats
Under Section 545.412(a), a driver transporting a child younger than eight must keep the child in a child passenger safety seat system according to the manufacturer’s instructions, unless the child is taller than four feet, nine inches. The offense carries a fine of $25 to $250, and under 545.412(e) the section does not apply to a vehicle transporting passengers for hire or to a vehicle in which all seating positions with safety seats or belts are occupied.
Personal Injury Protection
Under Texas Insurance Code 1952.152, an automobile liability policy must include personal injury protection unless any insured named in the policy rejects it in writing. Under 1952.151, the coverage pays reasonable expenses arising from the accident and incurred within three years, including necessary medical and funeral services and lost income for an income producer.
Each Defendant’s Share
Under Texas Civil Practice and Remedies Code 33.013(a), a liable defendant pays only the percentage of damages equal to its percentage of responsibility, unless 33.013(b) makes it jointly and severally liable because its percentage is greater than 50 percent or it acted in concert with another person, with specific intent to harm, in listed Penal Code conduct.
Amarillo Car Accident Questions
Can I recover if I was partly at fault?
Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $70,000 in damages and 30 percent of the responsibility on the injured driver: the recovery would be $49,000.
What if a City of Amarillo vehicle hit me?
Under Section 101.101, the city is entitled to notice of the claim within six months after the incident, or within a charter period that Texas law ratifies, unless it has actual notice of the injury. Under 101.023(c), a municipality’s liability is limited to $250,000 per person and $500,000 per occurrence for bodily injury or death.
How long do I have to sue the other driver?
Two years after the day the cause of action accrues under Section 16.003(a), and two years after the death for a wrongful death action under 16.003(b).
