Helmet Rules, Public Entity Claims and Wrongful Death Damages for Las Vegas Motorcycle Crashes
A Las Vegas motorcycle crash claim can raise who must wear a helmet under Nevada law, how a claim works when a city, county or State vehicle is involved, and what the family and the estate can recover when a rider dies. Nevada also sets a separate rule for adults who supply alcohol to an underage driver.
Helmets and Eye Protection
Under NRS 486.231(2), when a motorcycle or moped is driven on a highway, the driver and passenger must wear securely fastened protective headgear and protective glasses, goggles or face shields meeting the Department’s standards; under (3), a transparent windscreen meeting those standards replaces the eye protection, and (4) and (5) exempt authorized parades and enclosed-cab three-wheel vehicles other than trimobiles.
A City, County or State Vehicle
Under NRS 41.036, a tort claim against the State or its agencies is filed with the Attorney General, and a claim against a political subdivision with its governing body, within 2 years after the cause of action accrues; the filing is not a condition precedent to suing. Under NRS 41.035(1), an award against the State, a political subdivision or a public employee acting within the scope of employment may not exceed $200,000 per claimant, excluding interest from the date of judgment, and may not include punitive damages.
When a Rider Dies
Under NRS 41.085(2), the heirs and the personal representative may each bring an action against the person who caused the death. Under (4), each heir may recover for grief or sorrow, loss of probable support, companionship, society, comfort and consortium, and for the decedent’s pain, suffering or disfigurement, and those proceeds are not liable for the decedent’s debts.
Alcohol Supplied to an Underage Driver
Under NRS 41.1305, a person who serves an adult 21 or older is not liable for that adult’s later conduct, but a person who knowingly serves an underage person, or knowingly allows underage drinking on premises or in a conveyance under the person’s control, is liable for damages the underage person causes. Under (3), that liability does not apply to licensed sellers and their employees acting in the course of business.
Las Vegas Motorcycle Accident Questions
How long do I have to sue?
Two years under NRS 11.190(4)(e) for an action to recover damages for injuries to a person or for a death caused by the wrongful act or neglect of another, except as otherwise provided in NRS 11.215 or 11.217.
Can I recover if I was partly at fault?
Yes, if your negligence was not greater than the negligence of the defendants, under NRS 41.141(1). For example, imagine $75,000 in damages and 40 percent of the negligence on the rider: the recovery would be $45,000.
What coverage did the other driver need?
Under NRS 485.185(1), at least $25,000 for bodily injury to or death of one person, $50,000 for two or more persons and $20,000 for property damage in one crash.
