Helmet and Eye Protection for Riders Under 18, Lane Use and Uninsured Coverage for Fort Wayne Motorcycle Crashes

A Fort Wayne motorcycle crash claim can involve Indiana’s equipment rule for riders under 18, its lane rule for motorcycles, and the uninsured and underinsured motorist coverage an insurer must make available. Indiana then reduces the rider’s recovery by the rider’s share of fault.

Riders Under 18

Under IC 9-19-7-1(b), an individual under 18 operating or riding on a motorcycle or motor driven cycle on the streets or highways must wear a helmet meeting 49 CFR 571.218 and protective glasses, goggles or a transparent face shield. Under (a), the section does not apply in an autocycle.

The Full Use of a Lane

Under IC 9-21-10-6, a motorcycle is entitled to the full use of a traffic lane, no vehicle may be driven so as to deprive another of it, and motorcycles other than autocycles may ride two abreast in a single lane with the consent of both operators.

Uninsured and Underinsured Coverage

Under IC 27-7-5-2(a) and (b), an insurer must make uninsured and underinsured motorist coverage available in each auto or motor vehicle liability policy on a vehicle registered or principally garaged in Indiana, and the named insured may reject both, or either one alone, in writing.

The Comparative Fault Rule

Under IC 34-51-2-5 and 34-51-2-6, the rider’s contributory fault reduces compensatory damages in proportion and bars recovery only if it is greater than the fault of all persons whose fault proximately contributed to the damages.

Fort Wayne Motorcycle Accident Questions

Do adult riders in Indiana have to wear a helmet?

No. IC 9-19-7-1(b) requires a helmet and eye protection for individuals under 18 operating or riding on a motorcycle.

Can I recover if I was partly at fault?

Yes, unless your fault is greater than the fault of everyone else who contributed. For example, imagine $92,000 in damages and 25 percent of the fault on the rider: under IC 34-51-2-5 the recovery would be $69,000.

How long do I have to sue after a Fort Wayne motorcycle crash?

Two years after the cause of action accrues, under IC 34-11-2-4(a), and two years for a wrongful death action under 34-23-1-1. Against the city or another political subdivision, notice must be filed within 180 days after the loss under IC 34-13-3-8.
