Helmet Rules, Shared Fault and Underinsured Motorist Coverage for Reno Motorcycle Crashes
A Reno motorcycle crash claim starts with Nevada’s helmet and eye protection statute and its exceptions. Nevada law then sets how a rider’s own negligence affects recovery, how damages are divided among several defendants, and what uninsured and underinsured motorist coverage insurers must offer.
Helmets and Eye Protection
Under NRS 486.231(2), when a motorcycle or moped is driven on a highway, the driver and passenger must wear securely fastened protective headgear and protective glasses, goggles or face shields meeting the Department’s standards. Under (3), a transparent windscreen meeting those standards replaces the eye protection, under (4) the devices are not required in a parade authorized by a local authority, and under (5) they are not required on a three-wheel vehicle, other than a trimobile, with an enclosed cab.
A Rider’s Own Negligence
Under NRS 41.141(1), a rider’s comparative negligence does not bar recovery if it was not greater than the negligence of the defendants against whom recovery is sought, and under (2) the jury returns the total damages and each party’s percentage. For example, imagine $100,000 in damages and 30 percent of the negligence on the rider: the recovery would be $70,000.
Several Defendants
Under NRS 41.141(4), when recovery is allowed against more than one defendant, each is severally liable only for the portion of the judgment matching that defendant’s percentage of negligence. Under (5), joint and several liability is not affected in actions based on strict liability, an intentional tort, toxic or hazardous substances, concerted acts of the defendants, or a product manufactured, distributed, sold or used in Nevada, and under (3) a settling defendant’s settlement is deducted from the net recovery.
Uninsured and Underinsured Motorist Coverage
Under NRS 687B.145(2), insurers must offer, on an approved form, uninsured and underinsured vehicle coverage equal to the bodily injury limits sold for a passenger car or motorcycle, and the coverage lets the insured recover damages that exceed the other driver’s bodily injury limits, up to the insured’s own limits.
Reno Motorcycle Accident Questions
How long do I have to sue?
Two years under NRS 11.190(4)(e) for an action to recover damages for injuries to a person or for a death caused by the wrongful act or neglect of another, except as otherwise provided in NRS 11.215 or 11.217. A government vehicle changes the recovery: NRS 41.035(1) caps an award against the State or a political subdivision at $200,000 per claimant.
Is there a cap on punitive damages?
Yes, with exceptions. Under NRS 42.005(1), punitive damages require clear and convincing evidence of oppression, fraud or malice and may not exceed three times compensatory damages of $100,000 or more, or $300,000 when compensatory damages are less than $100,000; under (2), the limits do not apply to listed actions, including those against a manufacturer, distributor or seller of a defective product.
What must a driver who hits a rider do?
Under NRS 484E.010, stop and remain at the scene of an injury or death crash on a highway or premises open to the public; failing to do so is a category B felony with 2 to 20 years in prison and a $2,000 to $5,000 fine. Under 484E.030, the driver must give name, address and registration number, show a license on request and render reasonable assistance to the injured person.
