Comparative Fault, Several Liability and PIP Benefits for Portland Car Crashes

A Portland car crash claim in Oregon survives the injured person’s fault as long as it is not greater than the combined fault of those being compared, and each defendant pays only its own share. Oregon also requires personal injury protection benefits of up to $15,000 in medical expenses and sets the minimum liability payments a policy must cover.

Comparative Fault

Under ORS 31.600(1) and (2), contributory negligence does not bar recovery if the claimant’s fault was not greater than the combined fault of the parties against whom recovery is sought, third-party defendants liable to the claimant, and persons with whom the claimant settled, and damages are diminished by the claimant’s percentage of fault.

Several Liability

Under ORS 31.610(1) and (2), except as otherwise provided in the section, each defendant’s liability for damages arising out of bodily injury, death or property damage is several only and not joint, and the court enters judgment against each liable party according to the percentages of fault the trier of fact finds.

Personal Injury Protection

Under ORS 742.524(1)(a), personal injury protection pays all reasonable and necessary medical, hospital, dental, surgical, ambulance and prosthetic expenses incurred within two years after the injury, up to $15,000 in the aggregate per person.

Minimum Payments

Under ORS 806.070(2), an insurance policy used for financial responsibility must cover at least $25,000 for bodily injury to or death of one person, $50,000 for two or more persons and $20,000 for property damage in one accident.

Portland Car Accident Questions

How long do I have to sue after a Portland car crash?

Two years under ORS 12.110(1) for an injury to the person not arising on contract. A claim against a public body also requires notice of claim within 180 days after the injury under ORS 30.275(2)(b).

Can I recover if I was partly at fault?

Yes, if your fault is not greater than the combined fault of those compared with you. For example, imagine $80,000 in damages and 35 percent of the fault on the injured driver: under ORS 31.600 the recovery would be $52,000.

What must a driver do after an injury crash in Oregon?

Under ORS 811.705(1), a driver who knows or has reason to believe of a collision causing injury or death must immediately stop, reasonably investigate what the vehicle struck, remain at the scene and perform the listed duties, including giving information and rendering reasonable assistance.
