Birmingham Rider Claims Under Alabama Helmet, Right-of-Way and Fault Law

After a motorcycle crash in Birmingham, three questions come first under Alabama law: whether the rider met the helmet requirement, whether the other driver yielded as the right-of-way statute requires, and how contributory negligence applies to the facts.

Helmet Requirement and Young Riders

Ala. Code § 32-5A-245, as reproduced in a 2026 House bill, provides that no individual may operate or ride upon a motorcycle or motor-driven cycle unless wearing protective headgear complying with the standards in § 32-12-41, and shoes, except persons riding within an enclosed cab. A parent or guardian may not knowingly permit a juvenile in their care to ride without an approved helmet or without shoes.

Stop Signs and Yield Signs

Ala. Code § 32-5A-112(b) requires a driver approaching a stop sign to stop and then yield to any vehicle in the intersection or approaching closely enough to be an immediate hazard, which includes an approaching motorcycle. At a yield sign, subsection (c) makes a collision after driving past the sign without stopping prima facie evidence of the driver’s failure to yield.

Contributory Negligence and the Two-Year Limit

The Alabama Supreme Court declined to adopt comparative negligence in Golden v. McCurry (1980), keeping contributory negligence as a defense. Ala. Code § 6-2-38(l) requires an action for injury to the person not arising from contract and not listed elsewhere in the section to be brought within two years, and § 6-5-410(d) requires a wrongful death action within two years after the death.

Birmingham Motorcycle Accident Questions

How soon must a claim against the City of Birmingham be presented?

Ala. Code § 11-47-23 bars claims against a municipality for damages growing out of torts unless presented within six months from accrual.

What insurance proof must the other driver carry?

Ala. Code § 32-7A-6(a) requires the operator of a covered motor vehicle to carry evidence of an Alabama liability policy in the vehicle, such as an insurance card, the current declarations page, a binder or certificate of insurance, or a rental agreement specifying coverage.

May the driver leave before police arrive?

No, not after a crash causing injury or death. Ala. Code § 32-10-1 requires the driver to stop and remain at or near the scene until the duties in § 32-10-2 are met, and a vehicle involved in such a crash may not be moved until a law enforcement officer directs it.
