Eye Protection, Wrongful Death Recovery and Settlement Rules for Louisville Motorcycle Crashes
A Louisville motorcycle crash claim can involve Kentucky’s eye protection and license rules for every operator, its helmet rule for younger and newer riders, and the order in which a wrongful death recovery is paid. Kentucky also sets how a settlement with one party affects the claim against the others.
Equipment Every Operator Needs
Under KRS 189.285(1), no person may operate a motorcycle on a highway without a valid motorcycle operator’s license, an approved eye-protective device at all times the motorcycle is moving, and a rear-view mirror. Under (3), riders under 21, permit holders and operators licensed less than one year must also wear protective headgear.
Who Receives a Wrongful Death Recovery
Under KRS 411.130, the personal representative brings the action, and after funeral, administration and recovery costs the recovery goes wholly to a surviving spouse with no children, half to the spouse and half to the children if both survive, wholly to the children if there is no spouse, and otherwise to the parents. Punitive damages may be recovered if the act was willful or the negligence gross.
Settling With One Party
Under KRS 411.182(4), a release or covenant not to sue discharges the settling person from all liability for contribution but does not discharge others liable on the same claim unless it says so, and the claim against the others is reduced by the released person’s equitable share.
Duties at the Scene
Under KRS 189.580(1)(a), a driver involved in a crash causing injury or death must immediately stop, ascertain the extent of the injury, render reasonable assistance including arranging transport to medical care when needed or requested, and on request give the registration number and the names and addresses of the owner, occupants and operator.
Louisville Motorcycle Accident Questions
Do I have to wear eye protection on a motorcycle in Kentucky?
Yes. Under KRS 189.285(1)(b), a person may not operate a motorcycle on a highway unless using an approved eye-protective device at all times the motorcycle is in motion.
Can I recover if I was partly at fault?
Yes. Under KRS 411.182, the judgment states each party’s equitable share by percentage of fault. For example, imagine $115,000 in damages and 40 percent of the fault on the rider, with 60 percent on the driver: the recovery would be $69,000.
How long do I have to sue after a Louisville motorcycle crash?
KRS 304.39-230(6) sets two years for a tort action not abolished by the no-fault act, and KRS 413.140(1)(a) sets one year for an action for an injury to the person. Confirm with counsel which period governs a motorcycle claim; the one-year period is the shorter of the two. A claim over a city or county vehicle also runs under KRS 65.2002 to 65.2006, and an injury from a defect in a city street, bridge or sidewalk needs notice to the city within 90 days under KRS 411.110, stating when, where and how the rider was hurt.
