Phoenix Truck Crash Claims: Federal Equipment and Driver Rules, Arizona Liability
After a Phoenix truck crash, the condition of the truck and the qualifications of its driver are both governed by federal regulations, while Arizona law decides who answers for whose fault and whether damages can be capped.
Parts That Must Be Kept in Safe Condition
49 CFR § 396.3(a) requires every motor carrier to systematically inspect, repair and maintain the vehicles under its control and to keep parts and accessories in safe and proper operating condition at all times, including the frame and frame assemblies, suspension systems, axles and attaching parts, wheels and rims, and steering systems. Section 396.17 requires a documented periodic inspection of each listed component at least once every 12 months, for each vehicle in a combination.
Who May Be Behind the Wheel
Except as provided in subpart G, 49 CFR § 391.11(b) treats a person as qualified to drive a commercial motor vehicle only if the person is at least 21, can read and speak English sufficiently, can safely operate the vehicle type by experience or training, is physically qualified, holds a currently valid commercial license from one state, is not disqualified and has passed a road test or presented an accepted equivalent.
Arizona Rules on Liability and Damages
A.R.S. § 12-2506 makes each defendant’s liability several only, limited to its percentage of fault, except that a party is responsible for the fault of another person acting as its agent or servant and in the other situations listed in subsection (D). Article 18, Section 6 of the Arizona Constitution provides that the amount recovered for injuries shall not be subject to any statutory limitation, apart from its felony-conduct exception. Under A.R.S. § 12-2505(A), the injured person’s own fault reduces the damages proportionately without barring the action.
Phoenix Truck Accident Questions
What crash information must the carrier keep?
49 CFR § 390.15(b) requires a three-year accident register showing each accident’s date, the city or town and state, the driver, the number of injuries and deaths and any hazardous material release, plus copies of accident reports required by government entities or insurers.
Who may sue if a family member died in the crash?
Under A.R.S. § 12-612, the surviving spouse, a child, a parent or guardian, or the personal representative brings the action on behalf of the surviving spouse, children or parents, or on behalf of the estate if none survive, and the recovery is divided in proportion to each party’s damages.
What deadlines apply?
A.R.S. § 12-542 sets two years after accrual for a personal injury action, except as provided in § 12-551. If the truck belonged to a public entity, a claim must be filed within 180 days under § 12-821.01 and suit brought within one year under § 12-821.
