Helmet and Fault Rules Behind a Little Rock Motorcycle Claim in Arkansas
Arkansas does not require a helmet for every adult rider, and its fault statute counts a risk the rider assumed as part of the rider’s fault. Both points matter when a Little Rock rider brings a claim.
Who Must Wear a Helmet
According to the Governors Highway Safety Association’s state law summary (last reviewed by state highway safety offices in June 2025), Arkansas requires helmets for riders under 21 and repealed its universal helmet law in 1997.
Fault, Including Risks the Rider Assumed
Ark. Code § 16-64-122 compares the injured person’s fault with that of the parties sued: a lesser share reduces damages proportionately, while an equal or greater share bars recovery. Subsection (c) defines fault to include any act, omission, conduct, risk assumed, breach of warranty or breach of a legal duty that is a proximate cause of the damages. For example, imagine a rider with $80,000 in damages who is assigned 25 percent of the fault: the reduced award would be $60,000.
The Filing Period
The text of Ark. Code § 16-56-105 lists three-year actions without naming personal injury. Applying Arkansas law in Highland Industrial Park, Inc. v. BEI Defense Systems Co. (2004), the Eighth Circuit stated that Arkansas has a three-year statute of limitations for tort claims, including negligence claims, under that section.
Little Rock Motorcycle Accident Questions
Does a claim survive if the injured rider later dies?
Yes. Ark. Code § 16-62-101(a) allows an action for wrongs done to a person to be brought by the injured person or, after death, by the executor or administrator, and subsection (b) lets the estate recover for the loss of life as an independent element of damages.
How long does a family have to file a wrongful death case?
Ark. Code § 16-62-102(c) requires the action to be commenced within three years after the death. The personal representative brings it, or the heirs at law if there is no personal representative.
What liability limits must a qualifying policy carry?
Under Ark. Code § 27-19-605, a policy or bond is effective under § 27-19-604 only with limits of at least $25,000 for bodily injury to one person, $50,000 for two or more people and $25,000 for property damage in one accident. If the vehicle belonged to a city, county or other political subdivision, Ark. Code § 21-9-303 requires it to carry at least those minimums and caps the combined liability of the government and its employee at them unless more coverage was purchased; § 21-9-301 otherwise leaves political subdivisions immune from suit beyond their insurance.
