Driver Qualifications, Weekly Hours and Fault Apportionment in Macon Truck Crash Claims
Federal rules on who may drive a truck, how many hours a week the driver may work and which records the carrier keeps supply the first facts in a Macon truck crash. Georgia law then divides damages by each party’s share of fault and limits how counsel may argue a value for pain and suffering.
Who May Drive
Except as provided in subpart G, 49 CFR 391.11(b) qualifies a person to drive a commercial motor vehicle only if the person is at least 21, can read and speak English sufficiently, can safely operate the vehicle by experience or training, is physically qualified, holds one currently valid commercial license, is not disqualified and has completed a road test or presented an accepted equivalent.
Weekly Hours, Records and Inspection
Under 49 CFR 395.3(b), a property-carrying driver may not drive after 60 hours on duty in 7 consecutive days if the carrier does not operate every day, or after 70 hours in 8 consecutive days if it does; 395.3(c) allows a restart after 34 or more consecutive hours off duty. Under 395.8(k)(1), duty-status records are kept at least 6 months, under 390.15(b) the accident register is kept for 3 years, and under 396.17 each commercial motor vehicle must have passed a periodic inspection within the preceding 12 months.
How Damages Are Divided
Under O.C.G.A. 51-12-33(b) and (c), the trier of fact apportions damages among the liable persons by percentage of fault, considering everyone who contributed to the injury whether or not named in the suit, and each share is not a joint liability and is not subject to contribution. Under (d), a nonparty’s fault is considered if the plaintiff settled with that nonparty or a defendant gives notice at least 120 days before trial.
Arguing a Value for Pain and Suffering
Under O.C.G.A. 9-10-184, as rewritten by SB 68 in 2025, counsel may argue the worth or monetary value of noneconomic damages only after the close of evidence, at the party’s first opportunity to argue damages, and the argument must be rationally related to the evidence; a party with the opening and concluding arguments may not argue a different value in closing than in opening.
Macon Truck Accident Questions
How long do I have to sue the carrier?
Two years after the right of action accrues for injuries to the person under O.C.G.A. 9-3-33, and four years for a loss of consortium claim, except as otherwise provided in that article. For a truck owned by a city, county or the State, a written claim is due earlier: within six months under O.C.G.A. 36-33-5(b) for a municipal corporation, within 12 months under 36-11-1 for a county, and within 12 months of discovering the loss under 50-21-26 for the State.
Can I recover if I was partly at fault?
Yes, if you were less than 50 percent responsible. Under O.C.G.A. 51-12-33(a) and (g), damages are reduced by your percentage of fault, and a plaintiff 50 percent or more responsible recovers nothing. For example, imagine $240,000 in damages and 35 percent of the responsibility on the injured driver: the recovery would be $156,000.
Is there a cap on punitive damages?
Yes, with exceptions. Under O.C.G.A. 51-12-5.1(g), punitive damages are limited to $250,000, but under (f) no limit applies against an active tortfeasor who acted with specific intent to cause harm or while substantially impaired by alcohol, by drugs other than lawfully prescribed drugs taken as prescribed, or by an intentionally consumed toxic vapor, and under (e) product liability awards have no limit.
