Carrier Coverage, Driving Limits and Several Liability in Las Vegas Truck Crash Claims
Behind a Las Vegas truck crash claim sit federal rules on which trucks count as commercial motor vehicles, the coverage their carriers must hold and the driver’s daily driving window. Nevada law then decides how damages are divided among the driver, the carrier and others, and when punitive damages are allowed.
Which Trucks the Federal Rules Reach and Their Coverage
Under 49 CFR 390.5, a commercial motor vehicle includes a vehicle used on a highway in interstate commerce with a gross vehicle weight rating or gross combination weight rating, or actual gross weight, of 10,001 pounds or more, whichever is greater. Under 49 CFR 387.9, a for-hire carrier hauling nonhazardous property in interstate or foreign commerce in a vehicle rated 10,001 pounds or more must carry at least $750,000, and under 387.7 it may not operate until that coverage is in effect.
The Daily Driving Window and Post-Crash Testing
Except as otherwise provided in 49 CFR 395.1, 49 CFR 395.3(a) requires a property-carrying driver to have 10 consecutive hours off duty before driving, limits driving to 11 hours, bars driving after the 14th consecutive hour after coming on duty, and bars driving once more than 8 hours of driving time have passed without a consecutive 30-minute interruption. Under 382.303, a fatal crash requires alcohol and drug testing of the surviving driver, and an injury or tow-away crash requires it when the commercial driver is cited for a moving violation arising from the crash within 8 hours (alcohol) or 32 hours (drugs).
Several Liability Among Defendants
Under NRS 41.141(4), when recovery is allowed against more than one defendant, each is severally liable only for the portion of the judgment matching that defendant’s percentage of negligence. Under (5), joint and several liability is not affected in actions based on strict liability, an intentional tort, toxic or hazardous substances, concerted acts of the defendants, or a product manufactured, distributed, sold or used in Nevada.
Punitive Damages
Under NRS 42.005(1), punitive damages require clear and convincing evidence of oppression, fraud or malice and may not exceed three times compensatory damages of $100,000 or more, or $300,000 when compensatory damages are less than $100,000. Under (2), the limits do not apply to the listed actions, including those against a manufacturer, distributor or seller of a defective product or a person responsible for spilling a toxic or hazardous material.
Las Vegas Truck Accident Questions
How long do I have to sue the carrier?
Two years under NRS 11.190(4)(e) for an action to recover damages for injuries to a person or for a death caused by the wrongful act or neglect of another, except as otherwise provided in NRS 11.215 or 11.217. If the truck belonged to the city, the county or the State, NRS 41.035(1) limits the award to $200,000 per claimant and bars punitive damages.
Can I recover if I was partly at fault?
Yes, if your negligence was not greater than the combined negligence of the defendants, under NRS 41.141. For example, imagine $400,000 in damages and 25 percent of the negligence on the injured driver: the recovery would be $300,000.
Can a missing seat belt be used against me?
No. Under NRS 484D.495(4)(b), a seat belt violation may not be considered as negligence or as causation in any civil action.
