Driver Testing, Carrier Coverage and Public Road Claims in Sacramento Truck Crashes
A Sacramento truck crash can involve the driver’s fitness for duty, the carrier’s insurance, and, when road design or upkeep played a part, a public entity. Each runs on its own rule and its own clock.
Alcohol and Testing
Under 49 CFR 382.201, a driver subject to the federal testing rules may not report for or remain on safety-sensitive duty with an alcohol concentration of 0.04 or greater. Under 49 CFR 382.303, a fatal crash requires alcohol and drug testing of the surviving driver, and an injury or tow-away crash requires it when the commercial driver is cited for a moving violation arising from the crash within 8 hours (alcohol) or 32 hours (drugs); if the alcohol test is not given within 2 hours the carrier records why, and attempts stop at 8 hours, with drug testing attempts ending at 32 hours.
Carrier Coverage
Under 49 CFR 387.9, a for-hire carrier hauling nonhazardous property in interstate or foreign commerce in a vehicle rated 10,001 pounds or more must carry at least $750,000, with $1,000,000 or $5,000,000 for listed oil and hazardous materials. Under 387.7, the proof of that coverage is public information produced on reasonable request.
The Annual Inspection
Under 49 CFR 396.17, each commercial motor vehicle, including each unit of a combination, must have passed a periodic inspection within the preceding 12 months, with documentation on the vehicle.
A Dangerous Condition of Public Property
Except as provided by statute, Government Code § 835 makes a public entity liable for injury caused by a dangerous condition of its property if the property was dangerous at the time of injury, the condition proximately caused the injury and created a reasonably foreseeable risk of that kind of injury, and either an employee’s negligent or wrongful act created it or the entity had actual or constructive notice in time to protect against it.
Sacramento Truck Accident Questions
What are the deadlines for a claim against a public entity?
Government Code § 911.2 requires an injury claim to be presented within six months after accrual. Under § 945.6, suit is due within six months after a written rejection notice is personally delivered or mailed, or two years from accrual if no notice is given.
Can I recover if I was partly at fault?
Yes. Li v. Yellow Cab Co. (1975) adopted pure comparative negligence. For example, imagine $500,000 in damages and 30 percent of the fault on the injured driver: the recovery would be $350,000.
How long do I have to sue the carrier?
Two years under Code of Civil Procedure § 335.1 for injury or death caused by another’s wrongful act or neglect.
