Seat Belt Rules, Uninsured Motorist Coverage and Insurance Minimums for Henderson Car Crashes
A Henderson car crash claim can raise how Nevada treats a seat belt violation in a lawsuit, what uninsured and underinsured motorist coverage the insurer had to offer, and what liability coverage the other driver had to carry. Nevada also pauses the filing period for an injured minor.
The Seat Belt Statute
Under NRS 484D.495(2), the driver and passengers 6 or older, or 57 inches or taller, in a vehicle covered by subsection 1 with an unladen weight under 10,000 pounds must wear an available safety belt. Under (3), a citation may be issued only when the vehicle is halted or the driver arrested for another violation, and the penalty is a civil penalty of up to $25 or community service. Under (4)(b), a violation may not be considered as negligence or as causation in any civil action.
Uninsured and Underinsured Motorist Coverage
Under NRS 687B.145(2), insurers must offer, on an approved form, uninsured and underinsured vehicle coverage equal to the bodily injury limits sold for a passenger car or motorcycle. The coverage lets the insured recover damages that exceed the other driver’s bodily injury limits, up to the insured’s own limits.
The Other Driver’s Liability Minimums
Under NRS 485.185(1), the owner of a vehicle registered or required to be registered in Nevada must continuously carry at least $25,000 for bodily injury to or death of one person, $50,000 for two or more persons and $20,000 for injury to or destruction of property of others in one crash.
Injured Minors
Under NRS 11.250, if the person entitled to sue is under 18, insane or in the State’s custodial care after placement while under 18 (with a listed exception) when the cause of action accrues, the time of the disability is not counted against the filing period.
Henderson Car Accident Questions
How long do I have to sue the other driver?
Two years under NRS 11.190(4)(e) for an action to recover damages for injuries to a person or for a death caused by the wrongful act or neglect of another, except as otherwise provided in NRS 11.215 or 11.217. If a city, county or State vehicle was involved, NRS 41.035(1) limits the award to $200,000 per claimant, without punitive damages.
Can I recover if I was partly at fault?
Yes, if your negligence was not greater than the negligence of the defendants, under NRS 41.141(1). For example, imagine $45,000 in damages and 20 percent of the negligence on the injured driver: the recovery would be $36,000.
What must the other driver do at the scene?
Under NRS 484E.030, give name, address and registration number, show a license on request, and render reasonable assistance to anyone injured, and if no police officer is present, report the crash to the nearest office of a police authority or of the Nevada Highway Patrol. Under 484E.010, leaving an injury or death crash is a category B felony with 2 to 20 years in prison.
