Chandler Car Crashes: Arizona Death Claims, Damages and Driver Duties
Arizona’s constitution and statutes shape both what a Chandler crash victim can recover and who may sue when a crash is fatal. The rules below also cover what drivers must do at the scene and how a victim’s own fault is treated.
No Statutory Limit on Damages
The Arizona Constitution provides that no law shall be enacted limiting the amount of damages to be recovered for causing the death or injury of any person, except that a crime victim is not subject to a claim by a person harmed while engaging in, attempting or fleeing felony conduct.
Who May Sue for a Death
Under A.R.S. § 12-612, a wrongful death action is brought by the surviving husband or wife, child, parent or guardian, or the personal representative, on behalf of the surviving spouse, children or parents, or on behalf of the estate if none of them survive. Either parent may bring the action for the death of a child, and the amount recovered is distributed in proportion to each party’s damages. A listed party found guilty of, or pleading guilty or no contest to, certain homicide or child abuse offenses involving the death is deemed to have died first and cannot recover.
Information and Help at the Scene
A.R.S. § 28-663(A) requires a driver in a crash causing injury, death or damage to an attended vehicle to give name, address and vehicle registration number, show a license on request and render reasonable assistance, including arranging for an injured person to be carried to a physician, surgeon or hospital when treatment is apparently needed or the person asks.
The Victim’s Own Fault
A.R.S. § 12-2505(A) reduces the full damages in proportion to the claimant’s fault without barring the action, unless the claimant intentionally, wilfully or wantonly caused or contributed to the injury. For example, imagine $90,000 in damages with the injured driver 10 percent at fault: the recovery would be $81,000.
Chandler Car Accident Questions
How long do I have to file against the other driver?
A.R.S. § 12-542 allows two years after the cause of action accrues, except as provided in § 12-551.
Does a claim against a public employee have its own deadline?
Yes. A.R.S. § 12-821.01 requires the claim to be filed within 180 days after accrual with the person authorized to accept service, including a specific settlement amount and supporting facts, and § 12-821 requires suit within one year after accrual.
How do I know whether I bought uninsured motorist coverage?
Under A.R.S. § 20-259.01(A), the declarations page sent to the named insured constitutes the final expression of the decision to purchase or reject uninsured motorist coverage, which insurers must offer by written notice.
