Wrongful Death Recovery, Punitive Damages and Filing Deadlines for Lexington Car Crashes
A Lexington car crash claim in Kentucky has to meet the two-year tort deadline in the Motor Vehicle Reparations Act. Kentucky also sets who receives a wrongful death recovery, when punitive damages are available, and how a jury weighs each party’s fault.
The Tort Deadline
Under KRS 304.39-230(6), a tort action not abolished by the no-fault act may be commenced not later than two years after the injury, the death, or the date of issuance of the last basic or added reparation payment made by any reparation obligor, whichever later occurs.
Who Receives a Wrongful Death Recovery
Under KRS 411.130, the personal representative brings the action, and punitive damages may be recovered if the act was willful or the negligence gross. After funeral expenses and costs of administration and recovery, the recovery goes wholly to a surviving spouse with no children, half to the spouse and half to the children if both survive, wholly to the children if there is no spouse, and otherwise to the parents.
Punitive Damages
Under KRS 411.184(2), punitive damages require clear and convincing evidence that the defendant acted toward the plaintiff with oppression, fraud or malice, and under (3) they may not be assessed against a principal or employer for an agent’s or employee’s act unless the principal or employer authorized, ratified or should have anticipated the conduct.
How the Jury Weighs Fault
Under KRS 411.182(2), in setting the percentages of fault the trier of fact considers both the nature of each party’s conduct and the extent of the causal relation between that conduct and the damages claimed, and under (3) the judgment states each party’s equitable share.
Lexington Car Accident Questions
How long do I have to sue after a Lexington car crash?
Two years after the injury, the death or the last no-fault benefit payment, whichever is later, under KRS 304.39-230(6). A claim against a city or county runs under KRS 65.2002 to 65.2006, and 65.2001(2) keeps the defense of governmental immunity for county governments. For an injury growing out of a defect in a city street, bridge, sidewalk or alley, KRS 411.110 bars the action unless notice reaches the mayor, city clerk or clerk of the board of aldermen within 90 days of the occurrence; ask counsel whether that notice applies to the local government involved.
Can I recover if I was partly at fault?
Yes. Under KRS 411.182, the court states each party’s equitable share according to the percentages of fault. For example, imagine $140,000 in damages and 45 percent of the fault on the injured driver, with 55 percent on the other driver: the recovery would be $77,000.
Do I have to meet the no-fault threshold for pain and suffering?
Yes. Under KRS 304.39-060(2)(b), pain and suffering damages require medical expense benefits over $1,000 or a listed injury such as a bone fracture, permanent disfigurement, permanent injury within reasonable medical probability, or death.
