Political Subdivision Claims, Wrongful Death Actions and Scene Duties for Lincoln Car Crashes

A Lincoln car crash with a city or county vehicle requires a written claim to the governing body within one year and a suit within two years. Nebraska also sets a two-year deadline and court approval for wrongful death settlements, and lists what a driver must do after an injury crash.

A Claim Against a City or County

Under Neb. Rev. Stat. 13-919(1), a claim against a political subdivision under the Political Subdivisions Tort Claims Act is forever barred unless made in writing to the governing body within one year after it accrued, and suit must begin within two years after accrual. The time to sue is extended six months from the mailing of notice of final disposition, or from withdrawal of the claim, if it would otherwise expire sooner.

Where the Claim Is Filed

Under Neb. Rev. Stat. 13-905, the claim is filed in writing with the clerk, secretary or other official responsible for records of the political subdivision, or with its law department where one is provided, and states the time and place of the occurrence and the pertinent facts.

A Wrongful Death Action

Under Neb. Rev. Stat. 30-810, a wrongful death action must be commenced within two years after the death by the personal representative for the exclusive benefit of the widow or widower and next of kin, and the recovery is distributed in proportion to each person’s pecuniary loss. The personal representative may not settle the claim until the appointing court approves the terms.

Duties at the Scene

Under Neb. Rev. Stat. 60-697(1), a driver involved in a crash on a public highway, private road or private drive resulting in injury or death must immediately stop, ascertain the identity of all persons involved, give name, address and the vehicle’s license number, exhibit the operator’s license, and render reasonable assistance to any injured person.

Lincoln Car Accident Questions

How long do I have to sue after a Lincoln car crash?

Four years under Neb. Rev. Stat. 25-207(3) for an injury claim against a private driver. A claim against a political subdivision must be made within one year and the suit begun within two years under 13-919(1).

What if more than one driver caused the crash?

Your negligence is compared with the total negligence of all persons you are suing under Neb. Rev. Stat. 25-21,185.09. For example, imagine $160,000 in damages, 30 percent of the negligence on the injured driver and 35 percent on each of two other drivers: the recovery would be $112,000, with economic damages joint and several and noneconomic damages several only under 25-21,185.10.

Can the other driver’s insurer pay less than my losses?

Yes, if the policy limits are lower. Under Neb. Rev. Stat. 60-534, the minimum liability policy covers $25,000 for one person, and under 44-6408(1) a policy on a vehicle principally garaged in Nebraska must include underinsured motorist coverage of at least $25,000 per person, which can answer for that shortfall.
