Punitive Damages, Medical Expense Proof and Wrongful Death Recovery for Columbus Car Crashes

A Columbus car crash claim against an impaired or reckless driver can raise when Georgia allows punitive damages and when the $250,000 limit does not apply. Georgia law also sets how medical expenses are proved after the 2025 tort reform law, requires owners to carry liability insurance, and decides who recovers when a crash is fatal.

Punitive Damages

Under O.C.G.A. 51-12-5.1(b), punitive damages require clear and convincing evidence of willful misconduct, malice, fraud, wantonness, oppression or that entire want of care raising a presumption of conscious indifference to consequences. Under (g), the award is limited to $250,000, except under (f) against an active tortfeasor who acted with specific intent to cause harm or while under the influence of alcohol, drugs other than lawfully prescribed drugs taken as prescribed, or an intentionally consumed toxic vapor to the degree that judgment was substantially impaired, and under (e) in product liability cases; under (h), the section applies to causes of action arising on or after April 14, 1997.

Proving Medical Expenses

Under O.C.G.A. 51-12-1.1, as enacted by SB 68 for causes of action arising on or after its April 21, 2025 effective date, special damages for medical and health care expenses are limited to the reasonable value of medically necessary care, determined by the trier of fact. When the plaintiff has health insurance, the evidence includes both the amounts charged and the amounts actually necessary to satisfy those charges under the insurance.

Owner’s Liability Insurance

Under O.C.G.A. 33-34-4, the owner of a motor vehicle required to be registered in Georgia may not operate it or authorize another to operate it without liability insurance equivalent to the security required by the Motor Vehicle Safety Responsibility Act, unless the owner has qualified as a self-insurer.

When a Crash Is Fatal

Under O.C.G.A. 51-4-2(a), the surviving spouse or, if there is none, the child or children may recover the full value of the life of the decedent, as shown by the evidence. Under (d), the recovery is divided equally among the spouse and children, with the spouse receiving at least one-third, and under (e) it is not subject to any debt of the decedent or the estate.

Columbus Car Accident Questions

How long do I have to sue the other driver?

Two years after the right of action accrues for injuries to the person under O.C.G.A. 9-3-33, and four years for a loss of consortium claim, except as otherwise provided in that article. A claim over a government vehicle starts earlier: O.C.G.A. 36-33-5(b) requires a written claim to a municipal corporation within six months of the event, and 36-11-1 requires claims against a county to be presented within 12 months; ask counsel which rule governs the government involved.

Can I recover if I was partly at fault?

Yes, if you were less than 50 percent responsible. Under O.C.G.A. 51-12-33(a) and (g), damages are reduced by your percentage of fault, and a plaintiff 50 percent or more responsible recovers nothing. For example, imagine $48,000 in damages and 30 percent of the responsibility on the injured driver: the recovery would be $33,600.

Does my policy include uninsured motorist coverage?

Yes, unless rejected in writing. Under O.C.G.A. 33-7-11(a)(1), a motor vehicle liability policy issued in Georgia must include uninsured motorist coverage, but the requirement does not apply where any insured named in the policy rejects the coverage in writing.
