The No-Fault Threshold, the 50 Percent Bar and Liability Limits for Detroit Car Crashes
A Detroit car crash claim for pain and suffering in Michigan has to show death, serious impairment of body function or permanent serious disfigurement, and it fails entirely if the injured person is more than 50 percent at fault. Michigan also sets the liability limits a policy must carry and the personal injury protection medical levels a driver can choose.
The No-Fault Threshold
Under MCL 500.3135(1), a person remains subject to tort liability for noneconomic loss caused by the ownership, maintenance or use of a motor vehicle only if the injured person has suffered death, serious impairment of body function or permanent serious disfigurement. Under (2)(c), no damages are assessed in favor of a party operating his or her own vehicle without the required security.
The More-Than-50-Percent Bar
Under MCL 500.3135(2)(b), damages in these actions are assessed on the basis of comparative fault, except that no damages are assessed in favor of a party who is more than 50 percent at fault.
Liability Limits
Under MCL 500.3009(1), an auto liability policy on a vehicle registered or principally garaged in Michigan issued after July 1, 2020 must carry at least $250,000 for bodily injury to or death of one person, $500,000 for two or more persons, and $10,000 for property damage, and under (5) an insured may choose lower limits, but not below $50,000 and $100,000, on the director’s form.
Personal Injury Protection Medical Levels
Under MCL 500.3107c(1), for policies issued or renewed after July 1, 2020, the personal injury protection medical coverage may be selected at $50,000 subject to Medicaid conditions, $250,000, $500,000 or without limit.
Detroit Car Accident Questions
How long do I have to sue after a Detroit car crash?
Three years after the death or injury, under MCL 600.5805(2), for an action for injury to a person or property. If a city, county or state vehicle hit you, MCL 691.1405 makes the governmental agency liable for its employee’s negligent operation of a motor vehicle the agency owns.
Can I recover if I was partly at fault?
Yes, if you are not more than 50 percent at fault. For example, imagine $120,000 in damages and 35 percent of the fault on the injured driver: under MCL 500.3135(2)(b) and 600.2959 the recovery would be $78,000.
Is leaving the scene of a crash a felony in Michigan?
Yes, when the crash results in serious impairment of a body function or death. Under MCL 257.617, a driver who knows or has reason to believe of the crash must stop and remain, and leaving is a felony punishable by up to 5 years or $5,000, or up to 15 years or $10,000 if the driver caused a crash that killed someone.
