The No Pay, No Play Rule, the 51 Percent Fault Bar and Insurance Minimums for Baton Rouge Car Crashes
A Baton Rouge car crash claim can turn on whether the injured driver carried the required liability security, because Louisiana bars an uninsured owner or operator from recovering the first $100,000 of each type of damage. State law also bars a driver 51 percent or more negligent, sets the other driver’s liability minimums, and limits which future medical costs are recoverable.
The No Pay, No Play Rule
Under Louisiana Revised Statutes 32:866(A)(1), an owner or operator who fails to maintain compulsory motor vehicle liability security cannot recover the first $100,000 of bodily injury or the first $100,000 of property damage from a motor vehicle accident. Under (A)(3), the limit does not apply if the other driver is cited and convicted of, or pleads nolo contendere to, operating while intoxicated, intentionally causes the accident, flees the scene or is committing a felony, or if the other vehicle was not being operated and was not in violation of the vehicle chapter.
The 51 Percent Fault Bar
Under Civil Code article 2323(A)(2), as amended effective January 1, 2026, a person whose own negligence is 51 percent or more recovers no damages, and a person below 51 percent has damages reduced in proportion. Under (D), when comparative fault goes to a jury, the jury is instructed on the effect of the article. Which version of the article governs a crash before January 1, 2026 is a question to confirm with counsel.
The Other Driver’s Liability Minimums
Under Revised Statutes 32:900(B)(2), a motor vehicle liability policy must cover at least $15,000 for bodily injury to or death of one person, $30,000 for two or more persons and $25,000 for damage to property of others in one accident.
Future Medical Costs
Under Civil Code article 2315(B), damages do not include costs for future medical treatment, services, surveillance or procedures unless they are directly related to a manifest physical or mental injury or disease, and damages include sales taxes paid on the repair or replacement of damaged property.
Baton Rouge Car Accident Questions
How long do I have to sue the other driver?
Under Civil Code article 3493.1, delictual actions prescribe in two years from the day injury or damage is sustained. For an injury sustained before July 1, 2024, confirm with counsel whether the earlier one-year period applies. A claim over a state or local government vehicle is also subject to the $500,000 cap on general damages per person in Revised Statutes 13:5106(B), which excludes medical care and lost earnings.
Can I recover if I was partly at fault?
Yes, if your negligence is below 51 percent. For example, imagine $58,000 in damages and 30 percent of the negligence on the injured driver: under article 2323(A)(2)(b) the recovery would be $40,600.
How long does a family have for a wrongful death claim?
Under Civil Code article 2315.2(B), one year from the death or two years from the day the injury was sustained, whichever is longer, and under (A) the surviving spouse and children may sue first, then the parents, siblings and grandparents in that order.
