Helmet Exception, State Road Claims and Drunk Driving Rules for Austin Motorcycle Crashes

An Austin motorcycle crash claim can raise what counts as a qualifying health plan under the Texas helmet exception, what happens when a state road condition or state vehicle was involved, and how Texas treats an intoxicated driver in both the criminal and civil systems.

What Counts as a Health Insurance Plan

Under Texas Transportation Code 661.003(c), a rider at least 21 who has completed a Chapter 662 motorcycle operator training and safety course or is covered by a health insurance plan with medical benefits for motorcycle collision injuries is excepted from the headgear rule. Under 661.003(i), a health insurance plan means an individual, group, blanket or franchise insurance policy, insurance agreement, evidence of coverage, group hospital services contract, health maintenance organization membership or employee benefit plan that provides benefits for health care services or medical or surgical expenses from a collision.

A State Road or State Vehicle

Under Texas Civil Practice and Remedies Code 101.021, a governmental unit is liable for injury from an employee’s operation or use of a motor-driven vehicle when the employee would be personally liable, and for injury caused by a condition or use of tangible personal or real property. Under 101.023(a), the state’s liability is limited to $250,000 per person and $500,000 per occurrence for bodily injury or death, and under 101.101 notice is due within six months after the incident unless the unit has actual notice. A state employee’s emergency response is treated differently: under 101.055(2), the chapter does not apply if the action complied with the laws for emergency action or, absent such a law, was not taken with conscious indifference or reckless disregard for others’ safety.

A Drunk Driver

Under Texas Penal Code 49.04, operating a motor vehicle in a public place while intoxicated is a Class B misdemeanor with a minimum of 72 hours of confinement, and a Class A misdemeanor with an alcohol concentration of 0.15 or more. In the civil claim, the exemplary damages cap in Civil Practice and Remedies Code 41.008(b) does not apply under 41.008(c) to conduct described as intoxication assault or intoxication manslaughter.

Uninsured Motorist Coverage

Under Texas Insurance Code 1952.101, uninsured or underinsured motorist coverage protects insureds legally entitled to recover from owners or operators of uninsured or underinsured motor vehicles for bodily injury, death or property damage, and an automobile liability policy must include it unless any insured named in the policy rejects it in writing.

Austin Motorcycle Accident Questions

Can I recover if I was partly at fault?

Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $75,000 in damages and 20 percent of the responsibility on the rider: the recovery would be $60,000.

How long do I have to sue the driver?

Two years after the day the cause of action accrues under Section 16.003(a) for personal injury, and two years after the death under 16.003(b) for wrongful death.

Who must be notified after a motorcycle crash in Austin?

The local police department, under Texas Transportation Code 550.026(a), when the collision occurs in a municipality and causes injury, death or damage leaving a vehicle unable to be normally and safely driven.
