Helmet Exception, Uninsured Drivers and Drunk Driving Rules for El Paso Motorcycle Crashes
An El Paso motorcycle crash claim can raise what kind of health coverage satisfies the Texas helmet exception, whether the rider’s own policy covers a driver with no insurance, and how Texas treats an intoxicated driver. A separate rule protects claims of injured riders younger than 18.
The Helmet Exception and Health Plans
Under Texas Transportation Code 661.003(c), the headgear rule does not apply to a person at least 21 who has completed a Chapter 662 motorcycle operator training and safety course or is covered by a health insurance plan with medical benefits for motorcycle collision injuries. Under 661.003(i), a health insurance plan includes an individual, group, blanket or franchise policy, a group hospital services contract, a health maintenance organization membership or an employee benefit plan that pays for health care services or medical or surgical expenses from a collision.
Uninsured and Underinsured Drivers
Under Texas Insurance Code 1952.101(a), uninsured or underinsured motorist coverage protects insureds legally entitled to recover from owners or operators of uninsured or underinsured motor vehicles for bodily injury, sickness, disease or death, or property damage, in at least the limits prescribed by Chapter 601 of the Transportation Code. Under (b) and (c), an automobile liability policy must include it unless any insured named in the policy rejects it in writing.
A Drunk Driver
Under Texas Penal Code 49.04, operating a motor vehicle in a public place while intoxicated is a Class B misdemeanor with a minimum of 72 hours of confinement, and a Class A misdemeanor with an alcohol concentration of 0.15 or more. In the civil claim, 41.008(c) of the Civil Practice and Remedies Code removes the exemplary damages cap for conduct described as intoxication assault or intoxication manslaughter.
Riders Younger Than 18
Under Civil Practice and Remedies Code 16.001, a person younger than 18 is under a legal disability; if the disability exists when the cause of action accrues, its time is not included in the limitations period.
El Paso Motorcycle Accident Questions
Can I recover if I was partly at fault?
Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $100,000 in damages and 25 percent of the responsibility on the rider: the recovery would be $75,000.
How long do I have to sue?
Two years after the day the cause of action accrues under Section 16.003(a) for personal injury, and two years after the death under 16.003(b) for wrongful death. If a City of El Paso vehicle hit the rider, the notice deadline is earlier: Section 101.101 entitles the city to notice within six months after the incident, or within a ratified charter period, unless it had actual notice of the injury.
What must a driver who hits a rider do at the scene?
Under Texas Transportation Code 550.021 and 550.023, stop, determine whether the rider needs aid, remain at the scene, give name, address, vehicle registration number and liability insurer, show a driver’s license on request and provide reasonable assistance to the injured rider.
