Headgear Rules, Scene Duties and Exemplary Damages for Garland Motorcycle Crashes
For a Garland rider, the Texas headgear statute applies unless the rider is at least 21 and meets its safety course or health coverage exception. Texas law also sets what the other driver must do at the scene, when exemplary damages are available, and whether the rider’s own policy covers a driver with no insurance.
The Headgear Rule
Under Texas Transportation Code 661.003(a) and (b), it is an offense to operate or ride as a passenger on a motorcycle on a public street or highway without protective headgear meeting the department’s safety standards, or to carry a passenger without it. Under (c), the rule does not apply to a person at least 21 who has completed a Chapter 662 motorcycle operator training and safety course or is covered by a health insurance plan with medical benefits for motorcycle collision injuries, and under (h) the fine is $10 to $50.
Duties at the Scene
Under Section 550.021(a) and 550.023, the driver of a vehicle in a collision that results or is reasonably likely to result in injury or death must stop, determine whether anyone needs aid, remain at the scene, give name, address, registration number and liability insurer, show a driver’s license on request and provide reasonable assistance to an injured rider. Under 550.021(c), failing to stop after a collision causing death is a second-degree felony and after serious bodily injury a third-degree felony.
Exemplary Damages
Under Texas Civil Practice and Remedies Code 41.003, exemplary damages require clear and convincing proof that the harm resulted from fraud, malice or gross negligence, and a unanimous jury. Section 41.008(b) caps them at the greater of two times economic damages plus noneconomic damages up to $750,000, or $200,000, with the felony exceptions listed in 41.008(c).
Uninsured Motorist Coverage
Under Texas Insurance Code 1952.101, uninsured or underinsured motorist coverage protects insureds legally entitled to recover from owners or operators of uninsured or underinsured motor vehicles for bodily injury, death or property damage, and an automobile liability policy must include it unless any insured named in the policy rejects it in writing.
Garland Motorcycle Accident Questions
Can I recover if I was partly at fault?
Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $100,000 in damages and 45 percent of the responsibility on the rider: the recovery would be $55,000.
How long do I have to sue?
Two years after the day the cause of action accrues under Section 16.003(a) for personal injury, and two years after the death under 16.003(b) for wrongful death.
What if a City of Garland vehicle hit me?
Under Section 101.023(c), a municipality’s liability is limited to $250,000 per person and $500,000 per occurrence for bodily injury or death, and under 101.101 the city is entitled to notice within six months after the incident unless a ratified charter period or actual notice applies.
