Helmet Rules, Hit-and-Run Penalties and Punitive Damages for Henderson Motorcycle Crashes

A Henderson motorcycle crash claim can raise Nevada’s helmet and eye protection statute, the duties and felony penalties for a driver who leaves an injury crash, and when the filing period pauses for an injured minor. Nevada law also sets when punitive damages are allowed and how high they can go.

Helmets and Eye Protection

Under NRS 486.231(2), when a motorcycle or moped is driven on a highway, the driver and passenger must wear securely fastened protective headgear and protective glasses, goggles or face shields meeting the Department’s standards. Under (3), a transparent windscreen meeting those standards replaces the eye protection, and (4) and (5) exempt authorized parades and enclosed-cab three-wheel vehicles other than trimobiles.

A Driver Who Leaves

Under NRS 484E.010, the driver in a crash on a highway or premises open to the public that injures or kills a person must stop and remain at the scene until meeting the duties in 484E.030; failing to do so is a category B felony with 2 to 20 years in prison and a $2,000 to $5,000 fine, and a separate offense for each person injured or killed. Under 484E.030, those duties include giving name, address and registration number and rendering reasonable assistance, including arranging transport for medical treatment when it is apparently necessary or requested.

Injured Minors

Under NRS 11.250, if the person entitled to sue is under 18, insane or in the State’s custodial care after placement while under 18 (with a listed exception) when the cause of action accrues, the time of the disability is not counted against the filing period.

Punitive Damages

Under NRS 42.005(1), punitive damages require clear and convincing evidence of oppression, fraud or malice and may not exceed three times compensatory damages of $100,000 or more, or $300,000 when compensatory damages are less than $100,000. Under (2), the limits do not apply to actions against a manufacturer, distributor or seller of a defective product, an insurer acting in bad faith, and the other listed defendants.

Henderson Motorcycle Accident Questions

How long do I have to sue?

Two years under NRS 11.190(4)(e) for an action to recover damages for injuries to a person or for a death caused by the wrongful act or neglect of another, except as otherwise provided in NRS 11.215 or 11.217. Against a public entity, the award is limited to $200,000 per claimant under NRS 41.035(1).

Can I recover if I was partly at fault?

Yes, if your negligence was not greater than the negligence of the defendants, under NRS 41.141(1). For example, imagine $110,000 in damages and 20 percent of the negligence on the rider: the recovery would be $88,000.

Does Nevada require uninsured motorist coverage?

No, but insurers must offer it. Under NRS 687B.145(2), an insurer must offer uninsured and underinsured vehicle coverage, on an approved form, equal to the bodily injury limits sold for a passenger car or motorcycle.
