Driver Records, Weekly Hours and Colorado Fault Rules in Aurora Truck Crash Claims

An Aurora truck crash claim turns on the carrier’s records of who drove and for how long, and on Colorado rules that compare the injured person’s fault and divide the rest among the parties and anyone else who contributed.

Driver Qualification

Except as provided in subpart G, 49 CFR 391.11(b) requires a commercial driver to be at least 21, to read and speak English sufficiently, to be able by experience or training to operate the vehicle safely, to be physically qualified, to hold a currently valid commercial license issued by only one jurisdiction, not to be disqualified, and to have passed a road test or hold an accepted equivalent.

Weekly Hours and the Logs

Under 49 CFR 395.3(b), a property-carrying driver may not drive after 60 hours on duty in 7 consecutive days, or 70 hours in 8 consecutive days if the carrier operates every day; 395.3(c) allows a restart after 34 or more consecutive hours off duty. Under 395.8(k)(1), the carrier keeps duty-status records and supporting documents for at least 6 months, and under 390.15(b) it keeps an accident register for 3 years.

The Fault Comparison

Under C.R.S. 13-21-111(1), the injured person’s negligence does not bar recovery if it was not as great as the negligence of the party against whom recovery is sought, and damages are reduced in proportion. An equal share bars recovery against that party.

Fault of People Not in the Case

Under C.R.S. 13-21-111.5(3), the finder of fact may consider the fault of a nonparty, such as a shipper or another driver, if the claimant settled with that person or a defendant gives notice of the nonparty’s fault within 90 days after the action begins, unless the court allows longer; no defendant pays more than its own percentage under subsection (1), except as provided in subsection (4).

Aurora Truck Accident Questions

How long do I have to sue?

Three years after the cause of action accrues under C.R.S. 13-80-101(1)(n), for tort actions for bodily injury or property damage arising out of the use or operation of a motor vehicle.

Can I recover if I was partly at fault?

Yes, if your share is smaller than the defendant’s. For example, imagine $100,000 in damages and 30 percent of the fault on the injured driver: the recovery would be $70,000.

What if a city or state vehicle was involved?

C.R.S. 24-10-109(1) requires written notice within 182 days after discovery of the injury, filed with the attorney general for a state claim and with the governing body or its attorney for any other public entity; compliance is a jurisdictional prerequisite.
