Truck Maintenance, Insurance and Testing Rules in Chandler Truck Claims

When a Chandler crash involves a commercial truck, three sets of federal records can matter: the carrier’s insurance, its maintenance and inspection files, and the driver’s post-crash test results. Arizona law then supplies the deadlines and the fault rule.

Carrier Insurance

49 CFR § 387.9 requires at least $750,000 in public liability coverage for a for-hire carrier hauling nonhazardous property in interstate or foreign commerce with vehicles rated at 10,001 pounds or more; listed oil and hazardous cargo carry $1,000,000 or $5,000,000 minimums for private and for-hire carriers alike. Section 387.7 makes the proof of that coverage public information that must be produced on reasonable request.

Maintenance Files and the Annual Inspection

Under 49 CFR § 396.3, a carrier must systematically inspect, repair and maintain every vehicle it controls, keep records of inspections, repairs and maintenance with their dates, and retain them for one year where the vehicle is housed or maintained and for six months after the vehicle leaves its control. Section 396.17 bars using a commercial motor vehicle unless each listed component passed an inspection within the preceding 12 months and documentation is on the vehicle; each unit of a combination, including each trailer, is inspected.

Post-Crash Alcohol and Drug Tests

49 CFR § 382.303 requires the carrier to test each surviving driver as soon as practicable after a fatal crash, and after a crash with an injury treated immediately away from the scene or a vehicle towed for disabling damage when the driver is cited for a moving violation arising from the crash within 8 hours (alcohol) or 32 hours (drugs). Alcohol testing efforts stop at 8 hours and drug testing efforts at 32 hours, with a written record of why a test was not given.

Arizona Fault and Filing Rules

Under A.R.S. § 12-2505(A), the injured person’s fault reduces the full damages proportionately without barring the action. A.R.S. § 12-542 requires an action for personal injury to be commenced within two years after accrual, except as provided in § 12-551.

Chandler Truck Accident Questions

The truck belonged to a city or other public entity. What changes?

A.R.S. § 12-821.01 requires a written claim with a specific settlement amount to be filed with the person authorized to accept service within 180 days after accrual; a late claim is barred. Section 12-821 then requires the lawsuit within one year after accrual.

Who may bring a claim if a family member was killed?

A.R.S. § 12-612 allows the surviving spouse, a child, a parent or guardian, or the personal representative to bring the action for the surviving spouse, children or parents, or for the estate if none survive; the recovery is distributed in proportion to each party’s damages.

Does the carrier pay for the driver’s share as well as its own?

Yes, if the driver was acting as its agent or servant. A.R.S. § 12-2506(D) makes liability several only, except that a party is responsible for the fault of another person who was acting as its agent or servant, and in the other listed situations of acting in concert or a duty under the Federal Employers’ Liability Act.
