Arizona Rules on Drunk Driving Crashes, Coverage and Scene Duties in Scottsdale

When alcohol is involved in a Scottsdale car crash, Arizona law can reach the business that served the driver as well as the driver. The rules below cover that liability, the uninsured motorist coverage an injured driver may have, and what the law requires of drivers at the scene.

When a Bar or Restaurant Can Be Liable

A.R.S. § 4-311(A) makes a liquor licensee liable for personal injuries, property damage or wrongful death if a court or jury finds that the licensee sold spirituous liquor to a purchaser who was obviously intoxicated, or to a purchaser under the legal drinking age without asking for identification or with knowledge of the age; that the purchaser consumed it; and that the consumption was a proximate cause of the harm. Under § 4-312(A), a licensee is not liable to an adult consumer over the drinking age who is hurt, or to an adult companion who was present and knew of the impairment.

Uninsured Motorist Coverage Must Be Offered

A.R.S. § 20-259.01(A) requires every insurer writing motor vehicle liability policies to offer uninsured motorist coverage by written notice, in limits not less than the policy’s bodily injury limits, on a form approved by the director. The declarations page sent to the named insured is the final expression of the decision to purchase or reject that coverage.

Duties at the Scene

A.R.S. § 28-661(A) requires a driver in a crash causing injury or death to stop at or as close as possible to the scene and remain until the duties in § 28-663 are met. A driver who fails to do so after a crash causing death or serious physical injury commits a class 3 felony, or a class 2 felony if the driver caused the crash; for any other injury the offense is a class 5 felony.

Pure Comparative Fault

Under A.R.S. § 12-2505(A), the injured person’s fault reduces the full damages in proportion to that fault but does not bar the action. For example, imagine $40,000 in damages and 15 percent of the fault: the recovery would be $34,000.

Scottsdale Car Accident Questions

When does the 180-day public entity deadline start?

Under A.R.S. § 12-821.01(B), the cause of action accrues when the injured person realizes the damage and knows, or reasonably should know, its cause. A minor or an incompetent person may file within 180 days after the disability ends, and a filed claim is deemed denied 60 days after filing unless the claimant is told of a denial in writing sooner.

How long do I have to sue the other driver?

Two years after the cause of action accrues, under A.R.S. § 12-542, except as provided in § 12-551.

If two drivers caused the crash, can one be made to pay everything?

No, except in listed situations. A.R.S. § 12-2506 makes each defendant’s liability several only, limited to its percentage of fault, with joint liability only in listed situations such as parties acting in concert or a person acting as another’s agent or servant.
