Joint Liability, Uninsured Motorist Coverage and Leaving the Scene in St. Louis Car Crash Claims

A St. Louis car crash claim in Missouri can turn on whether a defendant bears 51 percent or more of the fault, which makes it answerable for the whole judgment. Missouri also requires uninsured motorist coverage that reaches hit-and-run drivers, sets liability policy minimums, and treats leaving the scene as a crime.

The 51 Percent Line for Defendants

Under RSMo 537.067, a defendant found to bear 51 percent or more of the fault is jointly and severally liable for the judgment, and a defendant below 51 percent is responsible only for its own percentage, except that a party answers for another defendant who was its employee or whose fault it bears under the Federal Employers’ Liability Act. Punitive damages are several only.

Uninsured Drivers and Hit-and-Run

Under RSMo 379.203(1), an auto liability policy on a vehicle registered or principally garaged in Missouri must include uninsured motorist coverage in at least the 303.030 bodily injury limits. The coverage applies when the at-fault driver left the scene before being identified, and whether or not there was physical contact.

Liability Policy Minimums

Under RSMo 303.190(2), a motor vehicle liability policy certified as proof of financial responsibility must cover at least $25,000 for bodily injury to or death of one person, $50,000 for two or more persons, and $25,000 for property damage in one accident.

Leaving the Scene

Under RSMo 577.060, an operator who knows of a crash causing injury, death or property damage and leaves without giving name, residence, vehicle registration or license number and operator’s license number commits a class A misdemeanor, a class E felony if physical injury was caused, and a class D felony if a death resulted.

St. Louis Car Accident Questions

How long do I have to sue after a St. Louis car crash?

Five years under RSMo 516.120(4) for an injury to the person not arising on contract and not otherwise listed. Under 516.170, a person under 21 or mentally incapacitated when the claim accrued may sue within that period after the disability is removed. For a city or state vehicle, RSMo 537.600(1) waives sovereign immunity for public employees’ negligent driving, and 537.610 limits the public entity’s liability.

Who pays if two drivers caused the crash?

It depends on each driver’s share. For example, imagine a $200,000 judgment with 60 percent of the fault on one driver and 40 percent on another: under RSMo 537.067, the 60 percent driver can be held for the full $200,000, while the 40 percent driver is responsible only for $80,000.

How long does a family have for a wrongful death claim?

Three years after the cause of action accrues, under RSMo 537.100, with time excluded while a defendant is absent from Missouri so that personal service cannot be made.
