Helmet Rules, the Helmet Evidence Bar and City Claims for Baltimore Motorcycle Crashes

A Baltimore motorcycle crash claim can involve Maryland’s helmet rule for every operator and rider and its rule that not wearing a helmet cannot be used to reduce recovery. Maryland also caps noneconomic damages and requires one-year notice for a claim against Baltimore City.

Helmets and Eye Protection

Under Md. Code, Transportation § 21-1306(b) and (c), an individual may not operate or ride on a motorcycle without protective headgear meeting the Administrator’s standards, and an operator must wear an approved eye-protective device unless the motorcycle has a windscreen. Under (a), the section does not apply to a person riding in an enclosed cab.

The Helmet Evidence Bar

Under Transportation § 21-1306(e), failing to wear required headgear may not be considered evidence of negligence or contributory negligence, may not limit the liability of a party or insurer, and may not diminish recovery for damages arising out of the operation of a motorcycle; no party, witness or counsel may refer to headgear at a civil trial unless the claim concerns the headgear’s design, manufacture, supply or repair. Other conduct by the rider can still matter: in Coleman v. Soccer Ass’n of Columbia (2013), the Court of Appeals of Maryland declined to abrogate contributory negligence, under which a plaintiff found contributorily negligent was barred from any recovery.

The Noneconomic Damages Cap

Under Courts and Judicial Proceedings § 11-108(b)(2), noneconomic damages are capped at $500,000 plus $15,000 for each October 1 since 1995, which is $980,000 for causes arising from October 1, 2026 through September 30, 2027, and the cap applies to each direct victim and those claiming through that victim.

A Claim Against Baltimore City

Under Courts and Judicial Proceedings § 5-304(b) and (c), notice of a claim against a local government must be given in writing within one year after the injury, to the City Solicitor for Baltimore City, in person or by certified mail.

Baltimore Motorcycle Accident Questions

Do adult riders in Maryland have to wear a helmet?

Yes. Transportation § 21-1306(b) applies to every individual who operates or rides on a motorcycle, except a person riding in an enclosed cab.

Can the other side argue I should have worn a helmet?

No. Under Transportation § 21-1306(e), not wearing required headgear may not be treated as evidence of negligence or contributory negligence, may not diminish recovery, and may not be mentioned at a civil trial unless the claim is about the headgear itself.

How long do I have to sue after a Baltimore motorcycle crash?

Three years from accrual under Courts and Judicial Proceedings § 5-101, unless another provision sets a different period, with one-year notice under § 5-304 for a claim against Baltimore City.
