Helmet Rules, Death Claims and Exemplary Damages for Corpus Christi Motorcycle Crashes
A Corpus Christi motorcycle claim meets the Texas headgear rule first, including its exception for riders 21 and older who completed a safety course or have qualifying health coverage. When a crash is fatal or the other driver was intoxicated, Texas statutes set who brings the family’s claim and how far exemplary damages can go, and the rider’s own policy may cover a driver with no insurance.
The Headgear Rule
Under Texas Transportation Code 661.003(a) and (b), it is an offense to operate or ride as a passenger on a motorcycle on a public street or highway without protective headgear meeting the department’s safety standards, or to carry a passenger who is not wearing it. Under 661.003(c), the rule does not apply to a person at least 21 years old who has completed a motorcycle operator training and safety course under Chapter 662 or is covered by a health insurance plan providing medical benefits for motorcycle collision injuries. Under (h), the offense is a misdemeanor punishable by a fine of $10 to $50.
A Fatal Crash
Under Texas Civil Practice and Remedies Code 71.002(b), a person is liable for damages from an injury that causes death if it was caused by that person’s or that person’s agent’s or servant’s wrongful act, neglect, carelessness, unskillfulness or default. Under 71.004, the action is for the exclusive benefit of the surviving spouse, children and parents; if none has begun it within three calendar months after the death, the executor or administrator must bring it unless all of them request otherwise.
Exemplary Damages and Intoxication
Under Section 41.003, exemplary damages require clear and convincing proof of fraud, malice or gross negligence and a unanimous jury. Section 41.008(b) caps them at the greater of two times economic damages plus noneconomic damages up to $750,000, or $200,000, and under 41.008(c) the cap does not apply to conduct described as intoxication assault or intoxication manslaughter, among other listed felonies.
Uninsured Motorist Coverage
Under Texas Insurance Code 1952.101, uninsured or underinsured motorist coverage protects insureds legally entitled to recover from owners or operators of uninsured or underinsured motor vehicles for bodily injury, death or property damage, and an automobile liability policy must include it unless any insured named in the policy rejects it in writing.
Corpus Christi Motorcycle Accident Questions
Can I recover if I was partly at fault?
Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $110,000 in damages and 20 percent of the responsibility on the rider: the recovery would be $88,000.
How long do I have to sue?
Two years after the day the cause of action accrues under Section 16.003(a) for personal injury, and two years after the death under 16.003(b) for wrongful death. A claim against the City of Corpus Christi or the state has an earlier notice step under Section 101.101: six months after the incident, or a ratified city charter period, unless the unit had actual notice of the injury.
What must a driver who hits a rider do at the scene?
Under Texas Transportation Code 550.021 and 550.023, stop, determine whether the rider needs aid, remain at the scene, give name, address, vehicle registration number and liability insurer, show a driver’s license on request and provide reasonable assistance, including transport for treatment when it is apparently necessary or requested.
