Arizona Helmet, Eye Protection and Lane Rules for Phoenix Riders
Arizona’s motorcycle statutes answer the questions that come up first after a Phoenix crash: whether the rider had to wear a helmet or eye protection, and whether the rider was allowed to be where the bike was, between lanes or alongside stopped traffic.
Helmets for Riders Under 18
A.R.S. § 28-964(A) requires an operator or passenger of a motorcycle, all-terrain vehicle or motor driven cycle who is under 18 to wear a safely secured protective helmet at all times. An officer may cite under that subsection only an operator or passenger who is 16 or 17 and holds a driver license or permit. The section does not apply to electrically powered three-wheelers or three-wheelers with an enclosed cab, farm vehicles in agricultural work, certain all-terrain vehicles, or vehicles operated on private property.
Eye Protection for Every Operator
The same subsection requires every operator, regardless of age, to wear protective glasses, goggles or a transparent face shield of a type approved by the director unless the motorcycle has a protective windshield.
Passing and Lane Filtering
Under A.R.S. § 28-903, a motorcycle operator may not pass in the same lane as the vehicle being overtaken or ride between lanes or rows of vehicles, except under subsection (F). That subsection lets the operator of a two-wheeled motorcycle pass a vehicle stopped in the same lane and direction, and ride between lanes, if the movement can be made safely, the street has at least two adjacent lanes in the same direction and a speed limit of 45 miles per hour or less, and the motorcycle travels no faster than 15 miles per hour.
Fault and the Filing Deadline
A.R.S. § 12-2505(A) reduces a rider’s damages by the rider’s share of fault without barring the claim. For example, imagine a rider with $80,000 in damages who is 30 percent at fault: the recovery would be $56,000. A.R.S. § 12-542 requires a personal injury action within two years after accrual, except as provided in § 12-551.
Phoenix Motorcycle Accident Questions
Can an adult rider be cited for a teenage passenger without a helmet?
Yes. A.R.S. § 28-964(C) allows an operator who is at least 18 to be cited when a passenger under 18 is not wearing the required helmet, or when a rider under 18 in the same group or party is not wearing one.
Can a car driver crowd a motorcycle out of its lane?
No. A.R.S. § 28-903(A) entitles every motorcycle to the full use of a lane and bars driving a motor vehicle so as to deprive a motorcycle of that use, except for motorcycles riding two abreast in one lane.
Is there a shorter deadline if a city vehicle hit me?
Yes. A.R.S. § 12-821.01 requires a claim against a public entity or public employee within 180 days after accrual, with a specific settlement amount and supporting facts, and § 12-821 requires suit within one year.
