Federal Carrier Rules and Colorado Employer Liability in Colorado Springs Truck Crashes
A Colorado Springs truck crash claim draws on federal rules for interstate motor carriers and on a Colorado statute that keeps direct negligence claims against the carrier alive even when it admits responsibility for its driver.
Coverage the Carrier Must Carry
Under 49 CFR 387.9, a for-hire carrier hauling nonhazardous property in interstate or foreign commerce in a vehicle rated 10,001 pounds or more must carry at least $750,000 in public liability coverage, with $1,000,000 or $5,000,000 for listed oil and hazardous materials. Under 387.7, the carrier may not operate until that coverage is in effect.
Driving Limits
Except as otherwise provided in 49 CFR 395.1, 49 CFR 395.3(a) requires 10 consecutive hours off duty before driving, limits a property-carrying driver to 11 hours of driving, bars driving after the 14th consecutive hour after coming on duty, and bars driving once more than 8 hours of driving time have passed without a consecutive 30-minute interruption.
Post-Crash Testing
Under 49 CFR 382.303, a fatal crash requires alcohol and drug testing of the surviving driver, and an injury or tow-away crash requires it when the commercial driver is cited for a moving violation arising from the crash within 8 hours (alcohol) or 32 hours (drugs); alcohol testing attempts stop at 8 hours and drug testing attempts at 32 hours.
Claims Against the Carrier Itself
C.R.S. 13-21-111.5(1.5) provides that when an employer or principal acknowledges vicarious liability for an employee’s or agent’s negligence, the plaintiff’s direct negligence claims against the employer are not barred, and the plaintiff may conduct discovery on them. The subsection states the legislature’s intent to reverse Ferrer v. Okbamicael (Colo. 2017), and it does not permit recovering the same damages twice.
Colorado Springs Truck Accident Questions
How long do I have to sue?
Three years after the cause of action accrues under C.R.S. 13-80-101(1)(n), for tort actions for bodily injury or property damage arising out of the use or operation of a motor vehicle. If a city, county or state truck was involved, C.R.S. 24-10-109(1) first requires written notice within 182 days after discovery of the injury, and compliance is a jurisdictional prerequisite.
Can I recover if I was partly at fault?
Yes, if your negligence was not as great as that of the party you are suing: C.R.S. 13-21-111(1) reduces damages in proportion. For example, imagine $100,000 in damages and 20 percent of the fault on the injured driver: the recovery would be $80,000.
Is pain and suffering limited in a truck case?
Yes. For an action filed in 2025 or a claim that accrues on or after January 1, 2025, other than a health care or wrongful death action, C.R.S. 13-21-102.5(3)(a)(II) caps noneconomic damages at $1,500,000.
