Helmet Rules, Scene Duties and Wrongful Death Actions for Portland Motorcycle Crashes

A Portland motorcycle crash claim can involve Oregon’s helmet rule for motorcycle operators, the duties of a driver after a crash that injures a rider, and the wrongful death action and its deadline. Oregon then compares the rider’s fault with the combined fault of those being compared.

The Helmet Rule

Under ORS 814.269, a person who operates a motorcycle without a motorcycle helmet commits a Class D traffic violation. Under ORS 814.290, the helmet rules do not apply within an enclosed cab or on a three-wheeled vehicle designed to travel at less than 15 miles per hour.

A Driver’s Duties After Hitting a Rider

Under ORS 811.705(1), a driver who knows or has reason to believe of a collision resulting in injury or death must immediately stop, reasonably investigate what the vehicle struck, remain at the scene and complete the duties the section lists, including giving information and rendering reasonable assistance.

A Wrongful Death Action

Under ORS 30.020(1), the personal representative may sue for the benefit of the surviving spouse, children and parents, others who would inherit, and any stepchild or stepparent, if the decedent could have sued, within three years after the injury causing death is discovered or reasonably should have been discovered, subject to the section’s outer limits.

Comparative Fault

Under ORS 31.600(1), contributory negligence does not bar recovery if the rider’s fault was not greater than the combined fault of the persons compared, and damages are diminished by the rider’s percentage of fault.

Portland Motorcycle Accident Questions

Do adult riders in Oregon have to wear a helmet?

Yes. ORS 814.269 applies to every person who operates a motorcycle, with the narrow exemptions in ORS 814.290 for enclosed cabs and slow three-wheeled vehicles.

Can I recover if I was partly at fault?

Yes, if your fault is not greater than the combined fault of those compared with you. For example, imagine $105,000 in damages and 40 percent of the fault on the rider: under ORS 31.600 the recovery would be $63,000.

How long do I have to sue after a Portland motorcycle crash?

Two years under ORS 12.110(1), and notice of claim within 180 days under ORS 30.275 for a claim against a public body.
