Arizona Filing Deadlines and Coverage Rules for Gilbert Car Accident Claims
The deadline that controls a Gilbert car accident claim depends on who is responsible: a private driver, or a public entity or public employee. Arizona’s insurance minimums also depend on when the at-fault driver’s policy was issued.
Claims Against Another Driver
Except as provided in § 12-551, A.R.S. § 12-542 requires an action for injuries done to the person to be commenced within two years after the cause of action accrues. When the injuries cause death, the action is treated as accruing at the death.
Claims Against a Public Entity or Public Employee
A.R.S. § 12-821.01(A) requires a claim to be filed with the person authorized to accept service within 180 days after the cause of action accrues, with facts explaining the basis of liability and a specific settlement amount supported by facts. Under subsection (C), when a statute, ordinance, rule or contract requires a dispute resolution or administrative claims process first, the claim does not accrue until that process is exhausted. A.R.S. § 12-821 separately requires every action against a public entity or public employee to be brought within one year after accrual.
Which Insurance Minimum Applies
A.R.S. § 28-4009(A)(2) sets two tiers. For a policy issued or renewed on or before June 30, 2020, or for a self-insured person, the minimums are $15,000 for one person, $30,000 for two or more people and $10,000 for property damage. For a policy issued or renewed beginning July 1, 2020, they are $25,000, $50,000 and $15,000.
Fault Reduces, but Does Not Bar, Recovery
Under A.R.S. § 12-2505(A), the claimant’s fault reduces the full damages proportionately instead of barring the action. For example, imagine $55,000 in damages with 20 percent of the fault assigned to the injured driver: the recovery would be $44,000.
Gilbert Car Accident Questions
Can the jury blame someone who is not in the lawsuit?
Yes, for the limited purpose of measuring fault. A.R.S. § 12-2506(B) has the jury consider the fault of everyone who contributed to the injury; a nonparty’s fault may be considered if the plaintiff settled with that person or a defendant gave notice before trial. The percentage assigned to a nonparty does not make the nonparty liable.
What if a bar served alcohol to an underage driver who hit me?
A.R.S. § 4-311 makes a licensee liable when it sold liquor to a purchaser under the legal drinking age without requesting identification or with knowledge of the age, the purchaser consumed it and the consumption was a proximate cause of the harm. Under subsection (C), if the underage purchaser causes injuries from drinking within a reasonable time after the sale, there is a rebuttable presumption that the purchaser consumed the liquor the licensee sold.
Whom must a driver notify after an injury crash?
Under A.R.S. § 28-666, a driver in a crash causing injury or death must immediately give notice by the quickest means to the local police department if the crash is within a municipality, the county sheriff’s office or the nearest highway patrol office.
